The Action Congress of Nigeria (ACN) candidate, and former president of the Nigeria Bar Association, Rotimi Akeredolu, had his petition defeated in the first ruling.

Justice Andovar Kaka'an ruled that the contention of the ACN that the election voters register had been "pumped up" was a pre-election matter, stating that the party and its candidate was aware of the issue before but did nothing about it. The tribunal therefore dismissed Mr. Akeredolu's petition for lack of proof.  Mr. Akeredolu was third in the gubernatorial election last year.

In the case of the PDP candidate, Olusola Oke, the tribunal stated that his evidence before the tribunal did not gell with his pleadings in which he asked to be declared the winner of the election, and his petition was thus dismissed instantly.
