According to a statement by Joe Obi, Special Adviser (Media) to the Aviation Minister, the action followed a Notice of Discontinuance filed by the state government.

The state government had initiated the action to compel the NCAA to release the aircraft.

NCAA counsel, Dr Alex Izinyon, objected to the competence of the entire action, praying the Court to dismiss the suit on grounds of want of jurisdiction.
