Ondo: Election Petition Tribunal ‎Grants Application As PDP Candidates Evade Service Of Court

‎The Chairman of the tribunal, Justice Anthony Ogar‎, who granted the application also ordered the counsels of the two political parties who had sought an ex parte motion to serve the defendants ‎notice on the election.

The National and State House of Assembly Election Petition Tribunal sitting in Akure‎, the Ondo State capital on Monday granted 10 applications on substituted service. 

The applications were filed by both counsels of the Peoples Democratic Party (PDP) and the All Progressives Congress (APC) party. 

‎The Chairman of the tribunal, Justice Anthony Ogar‎, who granted the application also ordered the counsels of the two political parties who had sought an ex parte motion to serve the defendants ‎notice on the election. 

Earlier, the three-man panel election petition tribunal headed by Justice Anthony Ogar had received 17 petitions out of which 4 were challenging the National Assembly ‎election, while the remaining 13 were for the State House of Assembly election. 

The lead counsel for the All Progressives Congress (APC), Tunji Abayomi in his application accused the candidates of the Peoples Democratic Party (PDP) who won the in just concluded election of evading service.

Abayomi mentioned that the party's candidates were the winners from Idanre, Ondo West I, and Ondo East constituencies.

He claimed that the candidates were intentionally evading service to frustrate the hearing of the petitions and pray that the court grant ex parte order for substituted service. 

But in Defence, the Counsel to the People ‎Democratic Party (PDP), Remi Olatubora said he had directed the State Chairman of the party, Clement Faboyede to personally collect all petitions against its candidates at the tribunal registry. 

Olatubora asked the tribunal to grant substituted service to the All Progressives Congress (APC) candidates who were declared winners for the House of Assembly election in five constituencies area of the state.

The areas are: Akoko North West 1, Akoko South West I and II, Akure South West II, and Owo Constituency II. 

SaharaReporters correspondent reported that all the concerned parties now have 14 days to respondent to the petitions leveled against them. 

In a short interview with SaharaReporters correspondent, Counsel to the APC, Tunji Abayomi expressed confidence that the election petition tribunal wouldn't be biased in its dealing over the petitions file before the court. 

Abayomi was optimistic that his clients would get justice from the tribunal added that the party has substantive evidences to pursue it's case before the court.

The Elections Petition Tribunal, which is using the hall of the National industrial ‎court on Alagbaka road as venue for its sitting has just 180 days to decide on all the petitions filed.
