Nigeria's Aviation Authority Imposes Paltry Fine Of N6M Against Arik Air Over Violation Of Passengers’ Rights

The Nigerian Civil Aviation Authority (NCAA) has sanctioned Arik Air for contravening the provisions of the Nigerian Civil Aviation Regulations (Nig.CARs), including a fine of six million naira to be paid within a period of seven days which began on December 22.

Accusing the airline of continuous violation of passengers rights, NCAA also ordered the troubled carrier to pay those passengers whose luggage were delayed on its London–Lagos flights between December 2nd and 4th the sum of $150 each.

The regulatory authority noted that the sanction is a civil penalty for violation of Part.19.7.2 of the Nig.CARs, 2015, and it is to be paid within 30 days commencing from December 22.

The decisions are contained in a Letter of Sanction dated December 22.  

In a statement to by its General Manager, Public Affairs, Sam Adurogboye, NCAA said it was inundated with complaints of delays and inability to ferry the passengers’ checked–in luggage on the Arik flights.

He further stated that upon receipt of those complaints, NCAA invited Arik Air to a meeting on December 6, and expressed regret that despite the meeting, Arik Air continued to embark on flouting of the Nig.CARs and the authority’s directives to freight the backlog of baggage to Lagos within 48 hours.

The statement observed that the carrier had declined to offer care and compensation to the affected passengers.

“Also, the airline did not inform the passengers at the soonest practicable time that their checked–in baggage would be off–loaded as required by Part 19.7.2 of the Nigerian Civil Aviation Regulations (Nig.CARs), 2015,” Adurogboye noted. 

He emphasized that the agency expected strict compliance with the provisions of Part 19 of the regulations by the airline in the future and assured all stakeholders that the authority existed to protect their rights at all times and promised that any violations would continue to be viewed seriously.
