El-Zakzaky’s Son Asks NBA To 'Sanction And Discipline' Malami Over Continued Detention Of Father

In a petition written to the NBA, Zakzaky’s son stated that Malami had failed in his constitutional duties for not advising the Federal Government to obey a court order on the release of his father as well as his mum, Malama Zeenat Ibraheem. He, therefore, asked that punitive measures should be enforced on Malami.

Mohammed Ibraheem Zakzaky, the only surviving son of detained Shi'ia sect leader, Sheik Ibrahim Zakzaky, has called on the Nigeria Bar Association (NBA) to immediately sanction and launch disciplinary measures against the Attorney General of Federation and Minister of Justice, Abubakar Malami.

In a petition written to the NBA, Zakzaky’s son stated that Malami had failed in his constitutional duties for not advising the Federal Government to obey a court order on the release of his father as well as his mum, Malama Zeenat Ibraheem. He, therefore, asked that punitive measures should be enforced on Malami.

Ibrahim, the only son of El-Zakzaky after the Nigerian Army had killed his three brothers in an attack in December 2015, maintained that the continued detention of El-Zakzaky and his wife is a clear violation of their fundamental human rights. He lamented that the detention is against an order by a competent court of law.

“The Federal High Court had ruled that the detention of Sheikh Ibraheem Zakzaky and Malama Zeenat Ibraheem Zakzaky at Abuja since December 2015 is illegal and unconstitutional as it violates their fundamental rights to personal liberty, dignity of person and fair hearing as enshrined in Sections 34, 35 and 36 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and Articles 5, 6 and 7 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act (CAP A10) Laws of the Federation of Nigeria, 2004," he wrote.

He further said that the AGF, who is also a Senior Advocate of Nigeria, ought to have ensured an immediate compliance with the court order and release his parents.

Ibrahim accused the AGF of complete disregard and disobedience to the court and the constitution.

He said: "This misconduct by AGF of leaving mortally injured citizens in the illegal custody of an agency of the government in contempt of Court judgment violates all relevant laws of the Federation that guarantee every one citizen the right to life, liberty and security and the right not to be deprived thereof except in accordance with the principles of fundamental justice.”

He challenged the NBA, which Malami is a member of, to enforce and uphold any punitive measures against the AGF, being the Chief Law Officer of the federation and a Senior Advocate of Nigeria (SAN).

He also asked that privileges accorded to the AGF be immediately withdrawn for the gross misconduct displayed by him.

The son of the Shi'ia leader finally urged the body to intervene in securing the release and enforcement of the rights of Sheikh Ibraheem Zakzaky and Malama Zeenat Ibraheem Zakzaky.
