Response To Atsar Terver’s “Why Salami Should Not Be believed.”
No I totally believe Justice Ayo Salami period...I believe and see this in the prism of an ordinary Nigerian. The sin of Justice Salami in the eye of the opponents is simple “Justice Salami has broken decades old code of silence, never to speak up against the powers that be in the Judiciary even if it is a matter that questions integrity and misconduct of Judges and leadership of the judiciary, as such he must be dealt with appropriately as a deterrent to others who might do the same or follow his lead.”
In Adolf Hitler’s Germany, Josef Goebbels was the megaphone and the propaganda machine of the Nazi Germany; he disseminates information from the third Reich, to the German people. He is the spokes man of the evil regime that planned and killed over 6 million people. In that Nazi Germany, discontent voices were shouted down and stifled and so it was until Nazi Germany was overrun by the allied forces and did away with Hitler’s third
Reich…misinformation was the order of the day. In our Nigeria today we have Josef Goebbels’s kind of Journalists/propaganda machineries and they are trying to swallow the voice of the majority, shout down the voice of reason and those who speak up against corruption and illegality especially the brewing controversy in the nation’s judiciary. But the unfortunate thing for them is that, the medium of communication and information dissemination monopoly is out of their reach and they are scrambling for every straw they can hold on to, to catch up with challenges and questions of the Nigerian people who want an independent Judiciary that adjudicates for everyone --poor and rich, big and small, ugly and beautiful.
Thankfully, Nigeria is a moving train, those who try to delay it will fall by the way side and left far behind, that will happen to people like Atsar Terver the rest of the Josef Goebbels like propaganda machine that wants to keep the status quo, Keep the old order; keep the domination of the click and gang that has given us a judiciary that delivers injustice 100 times over than justice. In Nigeria we have a Judiciary that is more inclined and interested in giving ridicules injunctions to the highest bidder and go into incommunicado. ..A judiciary that gives perpetual injunction to an accused so as to dodge prosecution and charges and …a judiciary that gives a clean bill of health to criminals and releases them into the society…wa oh! --the list of the sins of Judiciary is legion, the references to faulty judgment is uncountable, honest and incorruptible former judges and present judges can be counted on our fingers...A judiciary that is more interested in discussing cases on telephone, in their bedrooms and living rooms than in the court of law.
A judiciary that adjudicates not on law or constitution, but the caprices and evil of personal interest of the Judges—this is the kind of Judiciary well educated and trained guys like Terver Atsar and co are up in harms to defend…you guys will fail in our New Nigeria in this effort no matter how much you try. Trying to defend Justice Katsina-Alu’s misconduct is like dressing up a pig in an immaculate white. Saying that Justice Salami’s accusation against Justice Katsina-Alu cannot be substantiated is like saying that accusing former Governors Ibori of Delta state and Peter Odili of Rivers of corruption cannot be substantiated.
Coming back to Mr. Terver’s article, he is trying to paint Justice Ayo Salami as the corrupt Judge and want to ensure that he made the man look like a liar in the eye of the Nigerian people, but the truth is that he has succeeded in solidifying the resolve of the Nigerian people to look beyond the smoke screen. The more Justice Katsina-Alu’s propaganda machine, try to justify their subject’s actions and shield him from the scrutiny and the challenge of the Nigerian people the more they expose Justice Katsina-Alu to more questions and challenges.
Justice Salami, was not accused of misconduct by Justice Katsina-Alu, rather it was Justice Salami that accused Justice Katsina-Alu for misconduct. Justice Salami have not recanted his accusation of the Chief Judge nor apologized for accusing the Chief Judge. The Onus lies on Justice Katsina-Alu to come clean and seek redress. I hear some people say that it is wrong for Justice Salami to go public as such has brought the name of the judiciary to ridicule…really? Are the proponents asking for Justice Salami’s head for real? Quickly before I forget the judiciary has very little reputation left and made worst under the leadership of Justice Katsina-Alu.
According to Leadership Newspaper “At the heat of the matter, the NJC had risen from an emergency meeting in Abuja and ordered that the promotion be quashed on the ground that Salami should not be appointed to the Apex court against his will. The NJC was not impressed by the reasons advanced by the CJN for promoting the Court of Appeal President.” Is this true or false Mr Terver?
In recent days, some people are asking if it is not worth investigating Justice Salami for the accusation leveled against him by Senator Omisore, absolutely there is the need. That does not exonerate the CJN from the accusations on Sokoto gubernatorial case. Only those that are beneficiaries of a rigged election will see the sack of Edo, Osun, Ondo and Ekiti PDP governor’s as injustice. In Ekiti State in particular I hope we cannot forget so soon the activities of INEC in the rerun election. Hope we cannot forget so soon the activities of Justice Thomas Noran’s led tribunal in Osun state, who was discussing the states election tribunal case with the plaintiff’s Attorney via telephone and text messages, Justice Noran was never reprimanded nor fired from his position and was still allowed to deliver judgment…Mr. Terver did you ask for this to be substantiated? Is it an unsubstantiated fact that the judge is still in the Judiciary with no punishment as a deterrent even when there was clear evidence and petition against him…Justice Katsina-Alu is still working with him.
Mr. Terver and his proponents are acting as if to say it is only Justice Salami that has accused Justice Katsina-Alu’s of corruption, pretending as if to say Nigerians trust or believe in Justice Katsina-Alu before and after the accusation. Even before Justice Salami accused the Chief Judge of misconduct in Sokoto Gubernatorial case, many Nigerians know about the meddling in the case by Justice Katsina-Alu. The underlying fact, is that the constitution based on which the case of the 2007 election was adjudicated on, the gubernatorial cases end in the Appeal court, how did Sokoto Gubernatorial case end in Justice Katsina-Alu’s Judiciary lap at the Supreme court—Is Justice Katsina-Alu operating on different constitution?
I want Mr. Terver and his proponents to address how that case landed in the lap of Justice Katsina-Alu and not end in the Appeal court as required by the law of the land. It is imperative that Mr. Terver appropriately inform and educate his followers and the public where election matters on gubernatorial election end…the CJN crossed the line intervening in that case…we don’t need Justice Salami’s accusation to know that. What Justice Salami has done is to solidify what Nigerians already know about Justice Katsina-Alu, that he is a compromised judge long before the Sokoto case.
Already, some people say that they don’t expect Justice Katsina-Alu to come public and speak on the accusation leveled against him…this I strongly disagree with…the office of the CJN is the property of the Nigerian people and a public trust, the least Justice Katsina-Alu could do is to explain to the Nigerian people whose trust he is holding, his own side of the story, come clean and seek redress nothing less.
Is Mr. Terver encouraging and advocating for a judiciary that provided a platform that enable Justice Marcel Awokulehin to free Former Governor Ibori of all his criminal activity against the Delta people and the Nigerian people. Is it not a shame Mr. Terver that the UK is prosecuting Mr. Ibori for crime committed against the Nigerian people while the same Nigerian judiciary set him free and the man who performed that abracadabra is still a Judge irrespective of the petition against him.
The obvious truth is this, the powers that be in the judiciary are deeply mad at Justice Salami because a code of silence has been broken even in the face of evil and there is zero tolerance for discontented voice in the deeply corrupt and conservative judiciary. Justice Salami is person no grata in the judiciary, has threatened the modus operandi of shop clean mouth, no talk. Justice Salami, I don’t personally know you, wherever you are, if you are reading this please expose more, because we the Nigerian people cannot afford more of the same any more. It is better for us to have one honest Judge than have multitudes of corrupt irredeemable Judges.
If we the Nigerian people are serious of rebuilding Nigeria for the common good, If want a judiciary that stand for everyone, we cannot let Justice Katsina-Alu sit at the head of the Judiciary and his likes for a second more period! And he need to go now and that applies to any Judge found wanting including Justice Salami if found wanting! With all the evidence available to me I say it once again, I strongly believe in Justice Ayo Salami.

I am more interested in your MINDSET than anything else. The writer accuses some of 'Gutter journalism', while he is guilty of this too.
You copiously quoted The Leadership Newspaper (whatever credibility it has), but displayed your lack of openness or objectivity or your laziness to read further or acquire further knowledge by not realising that the same NJC made a statement and clarified what transpired at their deliberations and clarified their decision. The matter was still INCHOATE and as such, the NJC, that is saddled with making such 'promotion' (or recommendation to the President of Nigeria) could not have 'QUASHED' a decision they have not yet made.
I really do find Nigerians very bemusing sometimes, to say the least. It is only in Nigeria that people are 'guilty' of mere accusations on the pages of Newspapers or magazines. Only in Nigeria are people 'guilty' of accusations or allegations that are yet to be PROVEN. The legal principle is that the BURDEN OF PROOF IS ON HE WHO ALLEGES. It is not the other way round. The onus does not lie on Justice KATSINA to 'come clean' or prove his innocence.
For instance, I CANNOT MAKE ACCUSATIONS AGAINST YOU THAT YOU INFORMED ME THAT YOU PLAN TO BLOW UP ABUJA AIRPORT AND YOU (NOT ME) WILL BE EXPECTED TO DEFEND SUCH ACCUSATION or 'come clean'. No! It is not done like that! The burden and the onus of proof rests with me to prove that you said those things to me, just as the onus or burden of proof is on JUSTICE SALAMI to prove that Justice KATSINA (not KASTINA) uttered those words to him.
There have also been accusations of impropriety made against Justice SALAMI, including allegations of cavorting with the ACN Party. But that is not enough to call for his head or call for him to resign or be fired without FIRST proving the allegations are true or giving him a FAIR HEARING in court.
I doff my hat to Justice Katsina's candor and conduct in this whole affair, by maintaining a stoic and golden silence. He has acted like a boss, in this affair, and did not condescend or degenerate into the 'gutter' by equally slanging Justice SALAMI and continue the denigration or ridicule of the Judiciary and the noble profession, which has now become an all comers affair. It is at times like this that silence is golden.
ALL THE ACCUSATIONS ARE TOO SERIOUS OR FAR TOO GRAVE TO BE SWEPT UNDER THE CARPET OR RESOLVED BY WAY OF RECONCILIATION, EITHER BY THE NBA OR OTHER HIGH POWERED PANEL. NO WAY! THANKFULLY THE MATTER IS NOW IN COURT AND THEREFORE, SUB JUDICE, AND SHOULD ONLY BE RESOLVED IN COURT TO STRENGTHEN OUR JUDICIARY AND RESTORE HOPE TO THAT INSTITUTION, AS THE LAST HOPE OF THE COMMON MAN.
Perhaps, this case will teach Nigerians not to be too quick to judgement or descend to the alter of HEARSAY, HE SAID, OR I SAID, without PROVABLE FACTS!

Look who’s talking! What is in a call log? Has Segun Oni printed the call log he has had with the CJN, Mrs Ayoka as well as Mr Iwuruwuru? These politicians have no shame. In a country where the rule of law prevails, this man should be languishing in jail for blatantly rigging the elections in Ekiti state. From Citizen Reporters To Citizen Publishers
I always feel sad when I read Sahara Reporters because you guys, and the progressive pundits that comment here, really don’t seem to understand Nigeria. But you know and we know and THEY know that you are crucial for Nigeria. You make so much sense but people are not hearing it. It's like you are surprised that Nigerians cant see the obvious truth. but do they know the truth?
Right now, the man Deri, who is always commenting here on Sahara Reporters, with his virulent commentary, twisted misinterpretations and bigotry, is more reflective of the Nigerian masses than your reasonable articles. There is superstition, religionism, false histories, lack of logic, ethnicity, corruption, emotionalism all fusing up to create a way of thinking that confirms pre-determined outcomes. Deri is a pseudo intellectualisation of the way the masses of Nigeria think today.
The progressive views of Sahara Reporters and most of its pundits just stop here and perhaps go a little way into Nigeria's progressives. The average Nigerian in the market place, the waiter in the hotel, if he is Southern says GEJ is God sent. That's it. No more logic can change that. No high minded articles can change that. If you say GEJ is a thief, you hear "Is Babangida not a thief. It's our turn to steal." Why? Because he has already reached a pre-determined ethnic, religious conclusion - a Christian Southerner must rule. Instead of just stating that, as his tribalistic, religious belief, which is understandable, he will insist on squeezing and turning logic, history and reason, upside down.
Secondly, the average Nigerian really do not have the facts or the interpretation of the facts. He is just bombarded by the insipid Government Propaganda of NTA and the mostly sponsored articles of hungry Nigerian journalists in Newspapers. It seems only Channels News tries to be independent within circumscribed, unwritten rules of self censorship.
How can this be overcome? Sahara Reporters needs to expand its Citizen Reporters concept which has been very successful. Sahara Reporters needs to create Citizen Publishers. The success of Citizen Reporters is that no one knows them, so they cannot be targeted. Citizen Publishers can be equally amorphous.
Citizen Publishers should just be the army of Sahara Reporters Readers who can devote a part of their time and money to print out articles of Sahara Reporters, at least once a week and hand over to vendors to distribute. If Sahara Reporters take up this idea and start promoting it, readers can organise themselves in cells all over Nigeria. They will commit themselves to printing out a Weekend version of Sahara Reporters and handing it over to vendors for distribution to people that buy their Newspapers. The power of Citizen Publishers is that people will do it anonymously. There will be no one to say who is publishing what. There will be hundreds of Citizen Publishers all over the country. It is this process that will really educate the Nigerian masses with the truth as there will be at least one Citizen Publisher in most LGAS in the country.
Sahara Reporters can collate at the end of each week, the most salient articles it wants to be published by Citizen Publishers, revealing truths of crimes by politicians in as much lurid detail as they can. This can then be downloaded and printed. This type of news will sell like hot cake. It should not exceed 5 to 10 Sheets of A4 paper that can be printed in black and white. With a single rim of paper of 500 Sheets costing N600 and black ink about N2,500, one Citizen Publisher can produce 50 - 100 Sahara Reporter News-sheets a week for N3,100. I think many of us will be happy to devote N3,100 a week to do this for the sake of our country or to combine ourselves in small cells to share costs. One Thousand Citizen Publishers' Cells across Nigeria will produce 50,000 - 100,000 Copies. Over the week, with each copy being read by up to 10 people each, reaching 500,000 - 1,000,00 people, that would not, otherwise, read Sahara Reporters.
To really drive the idea and to encourage vendors to sell it, Sahara Reporters can fix a price of N50 - N100 on the front page of the Weekend Downloadable News-sheets, for the benefit of the Vendors, and to make Vendors take them seriously and not dump them. If the price is N100 then it can be shared by the Vendor and the Citizen Publisher to cover costs for the Citizen Publisher and still earn sufficient revenue for the Vendor. Because of its contents, it will certainly sell and the Vendors may even become Citizen Publishers themselves to make more profit. By the time Citizen Publishers reach 10,000 before the 2015 election 5,000,000 people will be reading Sahara Reporters weeekly.
If this is developed as a Business Model rather than a free sheet, Sahara Reporters can even make some money from this to support its very important work - and we will be all glad for it. By doing a deal with MTN, Citizen Publishers will have to text money to MTN to get the code to download each page of Sahara Reporters News-sheets. For the Citizen Publisher, each page will cost a N100 to download. With each Publication having 10 Sheets, that will be N1,000 per News-sheet, and N1,000,000 a week, for 1000 Citizen Publishers. The profits will drive Vendors and others that just want to start a business to make a little money on the side. It will then become a bonus for unemployed graduates, to start a business selling Sahara Reporters. By the time 10,000 publishers are involved in the next 4 years, Sahara Reporters will be making N10,000,000 extra a week.
The beauty of Citizen Publishers is that the publications can be free, or it can be developed as a business model with N50-N100 charged. It will fast become the most sought after material from Vendors because of its type of News. Even better, their will be no office to be raided. Aresting one Citizen Publisher cannot affect the rest. And the arrest cannot stick because they are not the producers of the news. A vendor cannot be jailed for libel in a Newspaper. It will achieve the same legal untouchability as having Sahara Reporters based in the USA. Even if Sahara Reporters goes on satellite, it is Citizen Publishers that can help it reach every nook and cranny, every village and hamlet, especially those that can’t afford satellite.
Until we can develop Citizen Publishers who can penetrate every part of Nigeria, preparing our people, and giving them the knowledge, logic and courage to face their fears and exploiters, coming to Sahara Reporters to intellectualise will continue to feel like a waste of time. However, after seeing the Egypt and Tunisia revolutions, I now know that these efforts will continue to fan new ideas, which perhaps over the next 4 years will penetrate into the Nigerian masses, as the young people with access to the internet, begin to understand, and to mobilise to become Citizen Publishers - not only to fight for change in the country, but to break free of unemployment and join the Sahara Reporters revolution.

It is time our Nigerian masses understood, that a thief is a thief is a thief and should be punished, whether or not other thieves escape. It is high time our Nigerian masses understood, that Atiku may be a thief and may have bribed delegates at the PDP primaries, but if Jonathan also bribed then he is a criminal who should not be President. Saying that Atiku bribed is no defence for the President. It is not Atiku who will be President. It is the President that we need to hold up to international standards of decency.
Right now people accept they must register, vote and defend their vote. Those arguments started on the internet. It is a step forward. But the vote the majority of the people in the South will defend today is GEJ's "God sent" vote. Perhaps in 4 years, with Citizen Publishers reaching 5,000,000 readers and changing the discourse even in rural areas, they will finally understand that the vote they should defend, is that of a corruption crusader not a corruption defender.
As regards Deri, I think he is sufficiently intellectualised to understand the ingenious twists of his arguments are illogical. I believe he knows and understands the truth, but deliberately argues for a pre-determined conclusion, because he is determined to confuse the less intellectual minds that come here, and who could get convinced by the truths here. In that, Deri does his job brilliantly, and all those that bother to persuade him otherwise are just wasting their time. He is not here to seek truth. He is here to systematically confuse truth, which he does so well because he knows what the truth is. As they say, it takes a thief to catch a thief. It takes one who knows the truth to destroy the truth. With Citizen Publishers, Deri and his ilk will have no hope of sullying the minds of the weaker thinkers amongst us.

Also observed in the call logs are consistent calls and SMS texts from the following ACN leaders to Justice Salami via the MTN mast at 11B, WAZIRI IBRAHIM ST. Some of the calls also originated from or terminated at Bourdillion street, which is well known as the area where ACN leader, BOLA AHMED TINUBU, has his residence.
“You will also recall that the ACN on the 4th October,2010 gave indications of having seen the judgement when Alhaji. Lai Mohammed, its Publicity Secretary, alleged in a press statement that the PDP was moving to arrest the yet undelivered judgement using the “Sokoto option’.
“One need not wonder now how the leakage of the judgement of the court to the ACN elements could have happened. Further investigation by security agencies will reveal the content of these communications which I believe were done to pervert the course of justice.
THIS INVESTIGATION WILL CONFIRM MY BELIEF THAT THE JUDGEMENT IN FAYEMI V ONI WAS TAINTED WITH CORRUPTION AND FRAUD.
Sir, it is trite that justice must not only be done but must be seen to have been done. I am also aware that the NJC and the Supreme Court have the power and the responsibility to redress glaring cases of abuse of court process or abuse of principles of fair hearing such as this one.

Salami and his druken sailor fisher men time to go
EMBATTLED President of the Court of Appeal, Justice Isa Ayo Salami and four justices of the court have till the close of work today to respond to the query issued to them over the Ekiti State governorship appeal panel by the National Judicial Council (NJC) or face sanction.
The query, which was dated February 8, 2011, ordered Salami and other affected jurists to respond within two weeks.
The two-week ultimatum expires today.
Those queried along with Salami were Justices Clara B. Ogunbiyi; O. Ariwoola; C.C Nweze and Adamu Jauro.
They were members of the governorship election appeal panel for Ekiti State, headed by Salami, which sacked former Governor Segun Oni of the Peoples Democratic Party (PDP) and enthroned Governor Kayode Fayemi of the Action Congress of Nigeria (ACN).
The state chapter of the PDP and Oni had petitioned the National Judicial Council (NJC), alleging unethical conduct and corruption in the handling of the appeal.
The justices were accused of being compromised and financially-induced in the course of delivering on the assignment.
Another panel raised by Salami had sacked the former Osun State governor, Prince Olagunsoye Oyinlola of the PDP and enthroned another ACN candidate, Governor Rauf Aregbesola.
The panel comprised Justices Ogunbiyi, Nweze, Jauro, M.L Garuba and Paul Galinje.
The trio of Ogubiyi, Nweze and Jauro reportedly got a double memo, due to their participation in the two controversial appeals.
Garuba and Jauro also participated in the Ogun state election petition appeal panel.
Salami had publicly said he trusted just nine justices of the court, out of the total 63, fuelling suspicion that he was running a clique in the system which did his bidding.
Senator Iyiola Omisore had petitioned the NJC over the judgment that sacked Oyinlola from office, alleging that Salami and his panel were compromised to deliver the judgment in favour of Aregbesola.
Checks at the NJC showed that their responses were yet to be sent in.
Another dimension to the appeal saga was the involvement of five Senior Advocates of Nigeria (SANs) in the alleged corruption that trailed the serial judicial victory of the ACN in the South-West.
The five SANs were listed as accomplices in the corruption saga, with the NJC expected to send the issues allegedly involving them to the Legal Practitioners Privileges Committee (LPPC), which wielded the disciplinary powers over them as far as the appointment of silk was concerned.
Their matter might also be referred to the Nigeria Bar Association (NBA) for further disciplinary actions, if found culpable.
A source in the system agreed with the Nigerian Tribune that the NJC had no power to probe the SANs, adding that the matter was, however, yet to be referred to the LPPC.
It was gathered that they were yet to file in their responses, which would determine whether a probe panel would be set up to investigate them.
It was gathered that the responses of the affected jurists would have to be scrutinised by members of the NJC at its next meeting scheduled for April and it was after a prima facie case had been established against the affected officers that a panel would be set up to probe and punish them.
Salmi and Katsina Alu should go
Even if Salami and Katsina Alu are saints, they should get the hell out of the Judiciary period. When Fela was jailed by Buhari the judge who sentenced him, visited him in hospital and apologised to him. The press said he sould go and he was fired. Why should Salami and Katsina Alu remain in their desk. What judgement will Salami deliver which the masses would not say was influenced or monitized by ACN? Already Salami has created the impression in the mind of the electorates that he was sponsored by ACN. Let both go. No more no less.
Go Salami, Go!
Justice Salami must go now. He has been compromised by ACN. He is no longer fit to be president of the Court of Appeal. Also, the CJN must also resign now. Both of these justices must leave the judiciary now for sanity to be restored.

salami is a crook. birds of the same feather flock to together. study the way ribadu worked as the chairman of efcc. he used the media very well. he hired the best hands in the press to raise his profile. that was what ACN did for Salami. they tried to weep up public sentiments in his favour against katsina alu.Alu himself could have sinned. so the best option is to fire chief ribadu tinubu salami and alu period. ACN and CPC dont campaigh. they use the press to talk to the masses.
