Bankole Acquittal: EFCC Files Swift Appeal

Demonstrating unusual purpose, the Economic and Financial Crimes Commission (EFCC) today filed a notice of appeal against yesterday’s judgment by Justice S.B. Belgore of the Federal High Court in which he dismissed the vast corruption charges brought against a former Speaker of the House of Representatives and his deputy.  The judge said the two men had no case to answer.

At the Court of Appeal in Abuja, EFCC prosecuting counsel, Festus Keyamo, re-affirmed the strength of the case against the former House chiefs, Dimeji Bankole and Usman Nafada, and asserted that Justice Belgore erred in law on various grounds, including the following:

•    Even though the accused person was not a signatory to the House of Representatives’ Account, so long as he took part in taking decisions that affected the operations of those accounts the way they were operated, then he was definitely entrusted with the accounts.
•    Evidence clearly shows that the accused person was present at meetings where it was collectively “resolved” to obtain loans and increase “running costs”. Without those resolutions, the accounts would not have been operated/accessed in the manner they were operated/accessed.
•    Both in fact and in law, the offence of theft can be charged together with criminal breach of trust, contrary to the decision of the learned trial judge.  All the ingredients of the offence of theft were proved by the prosecution.
•    So long as the accused person had no authority to approve and increase “running cost” and to obtain loans, then their resolution was an agreement to commit an act by illegal means.
•    The prosecution successfully established all the ingredients of the conspiracy to commit theft.
 
The EFCC said more grounds would be filed upon receipt of the records, and urged the Court of Appeal to set aside the ruling of the lower court and to remit the case for retrial before another judge.

Sources at the EFCC have told SaharaReporters EFCC they fully expected yesterday’s ruling because of the arrogant conduct and utterances of Mr. Bankole.  Among others, he posed as being above the law, refused to be interrogated, and boasted he would be acquitted eventually.

In a short period in office, Bankole systematically and ruthlessly assaulted the law and looted the accounts of the House.

On November 21, 2011, the court heard how Mr. Bankole and Mr. Nafada unilaterally increased allowances of members from N17 million per quarter to N42 million per quarter, thereby automatically dumping a burden of N60.480 billion annually on innocent Nigerians.  Worse still, they took a loan of N42billion from two banks to fund that burden, and diverted the excess accruing from the loan into their personal accounts.

Mr. Bankole used his new riches to purchase choice properties, some of them at giveaway prices.  He even “bought” his official residence for just N40 million. 

Yesterday, Justice Belgore deadpanned that although it is morally wrong, morally indefensible and morally insensitive for the House, under the leadership of Bankole and Nafada to have increased their allowances, alias “running costs” from N27million to N42million per quarter, per member, it was only a moral wrong, not a criminal offence, and set the men “free.”

Re-Bankole triumph at the high court

The judgement was not unexpected considering Dimeji's family status in Abeokuta and the corruption in the system. I only pity nigerians and Kiyamo in particular. May the good Lord help to the right and call so in nigeria-amen.

You just nailed it on the head. Where is the clerk of the assembly in this prosecution? The case is not going anywhere as long as they are prosecuting only half of the conspirators. They need to include all of them, especially the one that actually has the authority over these accounts.

mR aNANYMOUS, I do agree with you totally. The amount of curroption in FCT by the minister is too much to list. His initial re-appointment raised questions and people know why the president re-appointed him. The worst really is the amount of moey being embazzled. What ever happens now, he has filled his pockets unless the toothless EFCC comes (and make noises and disappear with time)

Bala Muhammed is perhaps one of the worst FCT Ministers that this country has known. Much worse than Aliero. Land allocation is fraudulently done through persons fronting for him. Fees and charges in FCT have risen astronomically and there is no evidence of use of the proceeds to develop Abuja. It will seem that rather than work and prove himself as capable, he is busy increasing fees and charges in Abuja, intoducing new ones and fraudulently amassing funds for what purpose I don't know. I pity the people of Bauchi were this sort of character to be elected governor there. If we had a purposeful FG, Bala would never have been reappointed or should have been sacked. But then, this Jonathan's world... corruption, greed and incompetence.

Bala Muhammed typifies what is wrong with governance in Nigeria. Very corrupt, impudent and visionless. Unless you are a Senator, you cannot succeed in getting land allocation under Bala. Most lands are allocated to his agents who then sell it to the public at premium price. I wonder whether he plans to be buried with all the useless and cursed money he is making. If his intention is to use the money to purchase the Bauchi governorship, then Abuja residents can only pray that he loses all of the money and be disgraced even at the primaries. He is just a common thief. No decorum, no integrity. He will be disgraced out of FCT. Barawoo! Ole! Thief!

What kind of country is Nigeria turning to. We are going from grass to terrible grass. In a country of law, Bankole will still be in jail pending trial for what he did. For this ignorant judge to dismiss the charges against him tantamount to a slap in the face of many Nigerian citizens. I would love to know where this judge got his law degree from. He need to go back to school. He need to tell Nigerians how much (out of the stolen money)he was paid. This is abuse of judicial power. He need to be dis-barred.
These people in government are making the civilized world to be laughing at us. No wonder they treat us like we are nobody when we travel abroad. This judge, Bankole and the likes of them will surely die one day and then what......?

Shame on festus keyamo.... Simple case u no fit win .... Efcc should get a serious criminal lawyer to try the case and not a "human rights" lawyer like keyamo who only knows how to conduct media trial .... The clerk of the Nass and clerk of the house of reps should be prosecuted alongside bankole if they really want to win the case.... Or else, the premise of the case is faulty ....

Bankole Acquittal

It is a shame that the Nigerian Judiciary could not find Bankole culpable of any wrong doing considering the magnitude of the financial mismanagement and embezzlement involved (40 Billion Naira).
It is also nonsensical of justice Balgore to have only mentioned that Bankole’s action was a mere moral issue. What message is he sending to the sitting speaker? to continue in line from where the disgraced former speaker Bankole left ?.
I think the whole case needs to be revisited and restitution forced on the involved parties at the least.
