Court Orders Release Of Information On Legislators’ Salaries And Allowances From 2007 To 2011

In a major boost to the rule of law in Nigeria, the Federal High Court, today in Abuja ordered the Clerk of the National Assembly to release to the Legal Defence and Assistance Project (LEDAP), details of the salaries, emoluments and allowancesthat were collected by national legislators between 2007 and 2011.

In a judgment delivered by Hon Justice B.B. Aliyu in a suit filed by LEDAP, against the leadership of the National Assembly under the Freedom of Information Act (FOI), the court held that the law Act permitted the non-governmental organization to demand any public information such as the details of salaries, emoluments and allowances earned by the legislators, being of public interest since they were from public funds.

Last September, LEDAP filed a suit to compel the clerk of NASS to furnish it with the information, claiming that the legislators were overpaid beyond the rate approved by law. LEDAP had earlier written to the clerk of the national Assembly for the information on the earnings of the legislators and demanded refund of overpayments. The request was ignored, leading to the suit.

The National Assembly argued through its counsel, Yunus UstazUsman, that the information requested by LEDAP was not permitted to be released under the FOI, and that the NGO lacked the locus standi to make such request. Overruling the objections, the judge said every citizen is entitled to have access to public information under the FOI Act, and ordered the Clerk of NASS to release the requested information within 14 days of the judgment.

It will be recalled that at the end of the 6th National Assembly in June 2011, it was widely reported that some legislators collected as much as N100m per quarter in allowances, excluding official salaries and emoluments, and that principals officers collected even more.

LEDAP considered the outrageous payment of allowances to legislators beyond the rate allowed by the statute to be unlawful.Through its lawyer, Chino Obiagwu, LEDAP said, “Legislators are those who made the law on how much each public officer should be paid in salary and allowances. It is unlawful and irresponsible for them to break the law and collect for themselves from public coffers much more than permitted by law. They are liable to refund any excess money collected beyond approved sum, and we will pursue this issue in thecourts until all unlawful overpayments to the legislators of the 6thAssembly are repaid to public coffers.”

Today’s judgement, which will have the principal aim of demystifying one aspect of the accounts of the National Assembly, could see many former and serving legislators having to repay vast sums of money.

Frivolous exercise.

Jonathan has signed a bill to free yourself from the strangulation of government and yet Nigerians are still in bondage. The information bill is now used to harass Jonathan and Jonathan only. We behave as if we have only one government in Nigeria. The kind of abuses directed to Jonathan if we target our governors and the state governors boys they called LGA chairman, Nigeria will be a better place.Why must it be only the president that they want to see his asset declaration and for what purpose? We like jumping up and down for nothing any little thing we head to court, that is why the court are slow to prosecute important cases. How do you expect our court to fast track criminal cases when cases instituted against a husband for eating two meats instead of one are still pending in our courts.

Nass is full of lawbreakers&fugitives the worse is the Senate.

This is a landmark ruling. The judiciary is now in charge given voice to voiceless and enforcing the state law as passed by NASS. It is only in Nigeria that legislators salaries are secret. The governor of Central Bank said we spend a quarter of our budget on salary and emolument of the legislator. It is time we let public know how much each is making. Every kobo that is in excess of the legislative salary should be refund with interest accrue.

Victims of north violence are now refugees in their country. Nigeria's government needs to resettle those victims before it becomes too late. We can no longer have a situation where people willingly kill their so-called co-nationals, damage their investments, send them down south as refugees, and at the end, what government does is beg the killers to stop killing. In what normal country can thousands be refugees in their own country? Time was when students destroyed university properties at any whim. But since the authorities started making them pay for those destroyed properties, incidents of students destroying properties got attenuated. Government must make way for federal allocations of destructive states be deducted at source to pay for deaths and damages caused. Enough is enough!

Jonathan cannot be forced to make assets public

The President answered that question yesterday in his media chat. If the law requires that he MUST declare that he should but I don't think if that is the case. Go to court if he's going against the law.

By the way, it is not the assets of the NASS that the case was brought before the court but the salary etc.
The President's is salary is a public knowledge.

It would be interesting to know if these so called dis(honorables) will obey the court other. I believe to enlongate the case they will appeal to the supreme court. Watch out. Next is the executive. Jonathan has said he does not give a darm about declaring his assets so let see where it goes from here. Kudos to the plaintiffs, LEDAP.

Reps dont deserve their pays/allowances,half of them illiterates

The release of such information will be an embarassement to Nigerians, as we know they have fat pay cheques they do not deserve, never worked for or earned. A professor in Nigeria cannot earn half the allowances these illiterate reps are recieving, which is unfortunate. There is a need for the constitution to equalize salaries based on one's educational qualification. After all, legistlators are civil servants, why should they earn higher than others?Some state legistlators do not even have formal education talk less of a diploma or degree. They sit in the house sleeping, and raising their hands when others do in the case of voting yes or nay, and those kind of people earn more than a professor, doctors, nurses, teachers, construction workers, plumbers etc? What a lost country.

Jonathan's assets are not public records so FOI Act does not apply. Jona haters should know that previous presidents refused to sign this act into law until Jona did. This is one of the many things he has done but a lot of people only think that roads and electricity are our only problem and if these are not fixed the government is not working

Democracy in Action

This judgement is a victory for democracy but bad news to the poor struggling citizens who form the bulk of the population. We all know that our law makers are the law breakers; they are above the law and accountable to none. Showing us details of their salaries, emoluments and other entitlements is good for the system but does the poor masses no good. It's more like adding salt to injury. We are better off not knowing their take home pay than knowing, knowning fully well that they won't make a refund neither do we have the power to stop them or change the system. If the GEJ does not give a damn to declare his assets, no member of his cabinets will give a damn to fight corruption

Nobody really can ascertain how much Nigeria Legislators make

This is a welcome move by the Federal High Court. Nobody really knows how much our Legislators make -their salaries, emoluments, allowances including Constituents allowances. What about BRIBERY on every single law, projects and approval they give. Nigeria’s House is filled with bunch of thieves!

You can trust the idiots rushing to appeal the ruling. I do not know why the NASS has not reverted tp their earlier emoluments before 2007. I don't understand the type of constitution that allows the NASS to fix their own salaries and allowances. It is unacceptable. If they think their pre-2007 emoluments are not sufficient, they should look for work elsewhere.

I wish the court could give Jonathan 14 days to make public his worth. If the FOI ACT is for everyone, Jonathan should make his assets public before he is forced to do so. That is, if the laws is applicable to all.

They should also tell Jonathan and the office concerned to release president Jonathan's asset declaration documents for the public to see. There actually seems to be a brewing war between the National Assembly and the excutive. The executive is out to expose the senators more so House of Rep. 

Legal Revolution

This is what I have been saying instead of a revolution on the streets that'll be bloody and probably not achieve anything, a legal revolution would see our rulers been made top adhere albeit grudgingly to the rule of law as it should be. Thanks LEDAP, n I implore others that can exploit the legal system to force the desired change we need in nigeria to pls stand up. Class action suits et al, is what we need.
