Free But Not really Free, 17 Year Old Comfort Monday Is Sent to Juvenile Correction Center After Police and Randy Uncle Framed Her For Stealing

Comfort Monday, the 17-year-old minor who was sentenced to prison by a Magistrate court judge for stealing has been released from prison. However, according to the Special Assistant on Social Welfare to the Lagos State governor, Busola Ogunkoya, Comfort’s freedom is limited as she is currently being held in a Lagos juvenile correction center at Idi-Araba.

Ogunkoya told Saharareporters today that Comfort, who gave birth to baby while in prison, was sent to the juvenile correction center because the Magistrate in charge of her case wanted to continue the litigation sometime next month and wanted the assurance that she would show up in court.

The Special Assistant said that State Governor Babatunde Fashola had personally requested her to secure Comfort’s freedom after reading about her plight on Saharareporters and several other online newspapers.  Furthermore, Mr. Fashola ordered the arrest of her Uncle, Nwitua Nadum, whose DNA would also be obtained in order to determine the paternity of Comfort's baby.

Comfort has alleged that Mr. Nadum was the father of her baby. She told the authorities Mr. Nadum brought her to Lagos from her poor farmer parents in Alimini, Port Harcourt, Rivers State after promising to send her to school only to constantly molest her and have forced sex with her several times, leading to her pregnancy. In collusion with the police in Oko Oba Divisional Police station, Mr. Nadum framed Comfort for stealing of N200,000, which led to the Magistrate court judge in Abule Egba area of Lagos to jailing her for stealing, despite her pregnant state as she could not get a surety for  stringent bail conditions granted her.

Ms. Ogunkoya told Saharareporters that Mr. Nadum is currently at the Panti Police station in Yaba, following his arrest last Friday.

Why jailed a 17yrs old girl without proper investigation.

Our judiciary system stinks.We should plan to allow the state attorneys office determines the process of a case, which case should be prosecuted if there is enough evidence or thown out for lack of evidence.These actions will not only stop the police from taking bribe but make the people understand their civil laws and duties.Please Fashola,go to the jail house and the prison everymonth to see and check cases similar to these.There lots of innocent people locked up without going through the court system and they need to be released if found not guilty to the offense charged them.

LET'S WAIT FOR MORE EVIDENCE

In criminal matters, people should be careful and refrain from jumping to conclusions before viewing available evidence.
Supposing the results of a DNA test shows that Nadum Nwitua is not the baby's father. What would you now say?.
Similarly, remanding Comfort at a juvenile center is the best Gov. Fashola can do for now. There is a pending criminal case of theft against her. Though she is presumed innocent until proven otherwise. She cannot just be freed by the Governor. The best that can happen is for the judiciary to speed-up the process so the truth can be known to all. Kudos to Governor Fashola.

We should use this case for study. So that we can also correct our mistakes as a state or nation. Many innocents are in the jail just like comfort of a kind.

For example. Consumers are really suffering they are in the jail of PHCN, Water cooperation, GSM, the educational system and others. THE NADUM I KNOW

The Nadum that i know as a friend is a respected menmber of the Diaspora community here in Uk. Upon seeing this article this afternoon, I made a call to him in Nigeria. In my discussion he assured me of his innocence.Nadum is one of those caurageous Nigerians who has taken steps like many us to invest in Nigeria thereby creating employment to Nigerians who steal you blind as a routine.Iam not holding brief for him as friend bcus i belief in the rule of Law and justce. As I write, he is taking step to undergo a DNA testing to prove his innocence. In view of this I will advice all SR followers like myself to hold their swords and wait for the outcome of the DNA testing which will be presented to the whole world including SR.An axxusedis assumed innocent untill proven otherwise.In as much as SR is doing a good job, we as a society cannot result to mub judgement without recourse to due process.

The child should be protected.

The child is a key witness against the incestuous Nadum, the rogue judge, the compromised DPO, etc, and as such should be protected from the machinations of all these culprits. And why is the girl still in detention? Fashola ought to have ensured that she is taken to a good hospital were she will be given proper post-natal care instead of keeping her in juvenile detention. Justice delayed is justice denied. I do not see any reason why Fashola is being applauded when he has not taken sufficient steps to ensure the girl and her baby's safety. And where are women's rights groups?

FASHOLA IDEA NOT SATISFACTORY

Am not sure why Nigerians continue to praise Fashola for continuing detention of this girl. Can he as a Governor not stand as a surety for the girl? Or can he not place the girl in Governor's lodge? Or can he not placed the girl in Hotel under 24hrs security? I am saying this because Fashola can do all those things but find it better to incarcerate this girl longer and I am sad. And for the 'Alleged Idiot', even if what he is saying is the truth, child labour coupled with servitude is still against our law (slavery). Although he is innocent until proven guilty but the fact remained that our Judicial system is facing severe strains and the authority had failed miserably. The police arresting the girl, the Magistrate sending her to prison, the prison incarcerating her as adult and Fashola re-incarcerating her and the child in Juvenile detention. I ask does anyone child deserved to be incarcerated at less than 1yr because of allegation on the mother for mere theft?

Thank you so much Sahara Reporters! Oh, what can I say? I am truly short of words.What started as a private pain which I shared with my wife and children is beginning to look like victory for Jesus! Thank you my little daughter Chioma who is only eight years old .When she said "Daddy I have an idea, you can ask SaharaReporters to help you bring her out of jail", little did I know that the Almighty God was speaking thru her.When I was growing up, we were taught not to open our mouth when our elders were talking, but i am glad that the spirit of God allowed me to listen to my little daughter .In the United States, it is normal to listen to our kids when they offer good ideas. The Nigeria police and Judges

This is an example of the mindset of the police and judges in our society. The police will arrest and extort without investigation. In Nigeria the police can shoot anyone if given money to do so by anybody. They are not better than assasins.They are ever telling lies.In civilised societies police investigate first and make arrest only on the strength of evidence.
We have the laziest judiciary in the world.Apart from endemic corruption, judges are very lax. They make ludicrous rulings whenever they chose to attend court. Their court attendance record is appalling. The reason we have unending adjournments.Our legal practice system is outdated.Lawyers are equally lazy.They hardly research cases and never do thorough investigation. You need to see how clusy and unprepared some lawyers present themselvs in court. The very reason most people have no faith in the justice system. They either endure or take their fate in their hands.

I also hope that on the back of this ugly incident, some good will come out of it. Though, Nigerians do not like talking about sexually matters openly, the harm being caused by not addressing such matters and turning into a taboo subject akin to "hear no evil; see no evil and speak no evil" is shocking when compare to the evil those perverts get away with. I must commend S.R. for your excellent reporting. You are making a much needed contribution to the advancement of Nigeria.
It is obvoius that many politicians are reading S.R. which invariable keeps some of them in check. Additionally, you are giving a voice to those who would have never had a chance to voice their displeasure with our Government. Your scope of reporting covers all boundaries of topics.
Nigeria is on the right track. Many of our youth read S.R. and are becoming more informed and involved. The time is coming when our votes will count, it is only then that the politicians will realize that if they do not perform, they will not smell any political position.This will begin to curb corruption (which in my opinion is our most pressing problem).
For 2011, I think that Ribadu, Buhari, Fashola or El- Rufai are some of the few people that could effect a much needed change. I am confident that in the near future many more qualified candidates will emerge.
Get rid of curroption and give us electricity and see how Nigeria will rise at an astronomical pace. The window of opportunity is short. If we do not get our act together within the next 12 months, Nigeria may become irrelevant.

As I see it there are 4 issues here:-First:When the young pregnant girl appeared in court and testified that her socalled guardian was responsible for the pregnancy, why did not the so-called learned judge believe her?When a dna test is carried ,will the guardian face the very serious charge of RAPE? Second:Will the learned judge then look into the case afresh and investigate the accusation of theft against this very vulnerable young person? Third: Will the so called guardian be compelled to pay child support untill the child is 18years old?Finally, the is the very serious crime of perjury. I do not have doubt anymore

I do not have doubt anymore that this Fashola is God sent, I am one of the die hard nonbelievers of those in government. Not that everybody don't have our faults but let ones good deeds outweigh his/her wrongs.

What this man has done, is what so many people including governors and, the president can't dare get into. Amongst my surprises is that he finds time to read Sahara reporters, not that other governors don't but they are either too weak to take positive actions to correct their mistakes or enjoy spending public funds to defend what they are absolutely guilty of.
