Jonathan Endorses Sack Of Justice Ayo Salami, Approves Appointment Of Acting President, Court Of Appeal

A terse press release from Rueben Abati, Jonathan’s Special Adviser on media and publicity stated thatJonathan has approved the recommendation of the National Judicial Council (NJC) to suspend Justice Ayo Salami from office over his refusal to apologize to the outgoing Chief Jusice of Nigeria, Alysius Katsina-Alu and the NJC as recommended by a committee headed by the chief judge of Nigeria, Ibrahim Auta.

The statement which was sent to the media on Sunday, reads: “President Goodluck Ebele Jonathan is in receipt of a correspondence dated 18th August, 2011, from the National Judicial Council (NJC), recommending the compulsory retirement of Hon. Justice Isa Ayo Salami, OFR, for misconduct in accordance with the provisions of Section 292 (1) (a) (i) of the 1999 Constitution of the Federal Republic of Nigeria, as amended, and Rule 1 (1) of the Code of Conduct for Judicial Officers of the Federal Republic of Nigeria.”
 

In a tone of acknowledgement of the controiversy surrounding the controversial suspension of the Justice Salami’s by a 7-manquorum out of 24 NJC members, the release further stated, “ Consequently, President Jonathan, in exercise of the powers conferred on him by Section 238 (4) of the 1999 Constitution of the Federal Republic of Nigeria as amended, has approved the acting appointment of Hon. Justice Dalhatu Adamu to perform the functions of the office of the President of the Court of Appeal pending when all issues relating to the office of the President of the Court of Appeal are resolved.” 

SaharaReporters learns that police orderlies protecting Justice Ayo Salami were removed yesterday on the oders of the IG of police.

The Judiciary has become politicised. Justice Katsina Alu appeared to be acting PDP script. It is very clear the action was calculated to partially clear Justice Salami and at the same time implicate him.It is now clear that the agenda is that of PDP. But dont forget that God is the overall Judge. With the high profile corruption cases in the country particularly in the judiciary, the country is in trouble. Dr. Jonathan is not ready to tackle the problem. He has 100% tolerance for corruption. He should pray his action will not backfire.

The truth is that because of the challeges OBJ got from Atiku, they decided this time to look for a very simple un-intelligent, incompetent personality to be the running mate for Yar'adua, they now looked for the most foolish of the Governors and found GEJ, as God will have it Yar'adua died, he then became President and that is called OPPORTUNITY. Elections came in April and two other factors played there, namely SENTIMENT and CORRUPTION. Jonathan is not a presidential Material. If He was ordinarily sitting in Bayelsa as Governor, He would not have dreamt of comiing to contest prersidecy in Nigeria, he cant. Why would you not wonder for Nigerians. Do you think Nigerians don't know their constitution? The president should be blamed because, if the NJC members who are for are less than those who are against the recommendation can't the president make reference to the constitution and refuse signing it. That's why he's leading us. If actually people are not dictating to him I don't see any reason why this should happen. I think there's something wrong somewhere. I advise the NBA to go a step further by shutting down the courts with a total non negotiable strike untill this wrong is corrected! How can a quorum of 7 out of 24 members take a binding decision on a body of supposedly independent minded senior members of the "Learned" profession? It can only happen in Nigeria!

Suspension of Salami

By endorsing the purported suspension of Justice Salami, I am begining towander if GEJ was actually attending classes when he claimed he went to school.

Good decision, Mr President!

Good decision by Mr President by allowing the rule of Law to prevail. It is not GEJ position to subvert but to enhance the rule of Law. Under Separation of Powers, the Judicial arm of Govt is independent of the Executive. In a DEMOCRACY, unlike MILITARY RULE (which most commentators on SR are used to or are apostles of), it is not Mr President's place or duty to subvert or thwart the decisions of the Judicial arm, but to enhance it by endorsing any Judicial decisions. The NJC is part of the Judicial arm of Government. Doing otherwise, by Mr President would amount to disregarding the rule of Law, and subverting it.
Btw, Justice Salami got his just and due recompense, by refusing to resign.
