LUTH Resident Doctors To Embark On Indefinite Strike Over Excessive Income Tax

Resident Doctors at the Lagos University Teaching Hospital [LUTH] have embarked on an indefinite strike action over the implementation of a new tax law which they criticize as exorbitant and lacking in uniform application.

Following a congress of the members last Friday which discussed the financial burden occasioned by the new tax law, the association immediately embarked on an indefinite strike action pending the resolution of the tax issues.

The Secretary of the Association of LUTH Resident Doctors, Dr. Kehinde Okunade, told SaharaReporters that the resolve to embark on a strike followed review of certain conditions of service at the hospital.

He said their work conditions were deteriorating every day, and that erratic power supply, lack of water in the hospital wards and poor training programs for the doctors, among other issues, have remained unresolved for many years. The management of LUTH, he added, has over-applied the federal government’s new tax law without bothering about the unpleasant conditions of service at the hospital.

“Despite that the condition of service here is too poor, there is no light in the wards, no water, blood bank not functioning properly and all they can do is implement a new tax law that some of us now pay N30,000 as tax,” he pointed out.

The doctors fault the manner of implementation of the new tax law at LUTH, noting that only doctors in the hospital pay in excess where their counterparts pay normal rate stipulated by the law.

The new tax law by the Federal Government came into effect in June 2011, but the resident doctors say it was introduced by the management at LUTH in August 2012.

“But the management began to take arrears of the new tax from January that it had not yet been introduced from our Call Duty allowances so that we were paying N58,000 in total tax now,” Dr. Okunade said.  The resident doctors also argued that their Call Duty allowance is normally not taxable.

The doctors also hold that they have previously made serious complaints about the issue, the outcome of which the joint tax board published last Monday and Tuesday in the national dailies explanations of rates to be paid according to the law. They allege that the published analyses by the joint tax board are not same as those being applied by the LUTH management.

“We [in LUTH] are the only ones paying this high. Others are also paying the new tax law but not as high as this. They pay the normal rate demanded by the new tax law but in LUTH, it is almost double what the new tax law asks that we pay.

“Joint tax board on Monday and Tuesday published in two national dailies the interpretation of the new tax law, which reveals to us that somebody who should pay about N17,000 according to the law is paying N38,000 in LUTH,” Dr. Okunade continued.

The doctors say that the message of their strike is that the management of LUTH should revert to the status quo to permit for proper discussion of the new tax system.  They say they are at a loss as to the calculation adopted by the management that has made their payable income taxes so high and as a result will not open for operations until their terms are met.

It would be recalled that Lagos State resident doctors were also recently in a showdown with the State Government over non-implementation of the Consolidated Medical Salary Scale [CONMESS], and embarked on a long strike action that denied medical attention to many people.  Those doctors also say their issue with the State Government has yet not resolved.

why do we go from here?

the hardship being imposed by the authority in Nigeria is just enormous. the brain drain presently being experienced among doctors will soon be on hourly basis if care is not taken and the trend is allowed to continue this way. why impose heavy taxation on a work force that keep sleepless nights just to ensure we have a healthy society.

I know u can't last an hour .luth as we have it now is a seat of corruption and a waste of resources.its time to all come together and make a fresh 50 yrs of quality tertiary health care service delivery.doctors in luth should fight for their right as it is allowed.stop comparing doctor state in Nigeria with their western world counterpart..no comparison between death and life .

Please take it easy. I know how painful it is to remove a penny from my salary, for that reason i wont blame you.But going by your argument that they remove 30,000 tax from your salary, i earned about £82,000 last year, i paid about £35,000 on income tax. Paid £2,600 council tax, £270 on road tax. We buy per litre of petrol £1.35 of which £0.95 is fuel tax. VAT on any goods bought is 20% VAT tax,. This has not included water bill, electricity bill, gas bill, phone bill which all carried VAT(tax).My medical schoolmate came from nigeria recently for few day, i was shocked to hear he goes to work 2-3 days in a week and get paid for 5 days. Even his salary was going while holidaying abroad because he was not on annual leave. You may argue that things work here sha.

oh please!!! we have been paying taxes for ages and haven't made noise about it, are doctors some sort of Angels who are not meant to pay taxes? if your tax is beyond the normal limits, take it up and get it sorted out like civilized people. one week one strike, how would this country be if we all decided to strike because someone did not bow down to greet us in the morning?

My mother died in LUTH in 1993, and it was this same problem of inadequate this and that! 19 yrs on, its still the same..SHAME ON US ALL....Any nation state abundantly blessed by natural resources esp CRUDE OIL , should not still stifle its citizen with a high tax rate, after all crude oil money is still shared amongst all tiers of government...My question..WE all know that Crude oil alone in Nigeria is enough to solve our problems without taxation. So why the heavy taxation, instead of plugging the corruption..Taxation is now used to buffer the leakages from corruption....Taxation is not the problem but Accontability, greed and bigmanism...I for one is against heavy taxation, it dampens morale, kills productivity and turns the populace to zombies and sheep...

People should mind their use of foul language and proffer logical reasoning.the doctors didn't say the management shouldn't implementthe tax law,they said they should implement it according to the law as stipulate in the Joint Tax board publication which is a public document.If you want to know what their colleagues pay as tax overseas, also ask how much their colleagues earn overseas,how many hours they work overseas, then before you exhibit irrational rantings.and also how much do you think patients pay for medical services overseas and how do they pay it? Much Ado about nothing. The Doctors should quit whining and pay their taxes. The money required to equip the hospitals and train doctors can't fall from heaven, but must come from taxation.

And please don't tell me there is enough money from oil exploration to meet all Nigerians' need. Everybody must sacrifice to make this nation move forward, including the Doctors.

Yes, we have to tackle corruption, the biggest problem in Nigeria, but Nigerians also need to pay taxes to fund infrastructure development. There is no free lunch any longer. We have too many issues to tackle, and our burgeoning population does not help matter.

Should Nigerians pay income

Should Nigerians pay income tax? I don't think so. Government should only collect tax if the money collected is going to be used for the provisions of good roads, water, health, security etc. In Nigeria money paid ended in the pockets of the politicians.
