Nigeria Crash Victim's Husband Sues Boeing, Pilot's Estate-CNN

Washington (CNN) -- A Nigerian man whose wife was among 153 people killed Sunday when a MD-83 aircraft crashed in Lagos, Nigeria, has filed suit against the manufacturer of the plane and its engines, and against the estate of the American who was piloting the aircraft.

 

In a 56-page lawsuit, David Chukwunonso Allison alleges that the plane and its engines were defective and "unreasonably dangerous," leading to the death of his wife of two years, Joy Allison.

The problem is you think you know something about law yet you know nothing!! The action is not one for breach of contract in which case you will be right, there's no contractual relationship between him and the manufacturer! But where a company manufactures a product for use by the public, the manufacturer owes a duty of care to any such user. Its an action in Tort. There is no requirement for a contractual relationship.

Wrong person to sue

I think his anger, which resulted in the lawsuit is totally misplaced. If the Airplane was a new and under some sort of warrantee then one can sue the manufacturer for making a defective product. However, the airplane is old (and I mean, really old) and it has out-lived it's service life objective. This mean that the manufacturer expects that the aircraft should be retired by now and in some sense do not guarantee it can be safely operated anymore. They always recommend rigorously checking old aircrafts to ensure airworthiness or retiring them if such facilities aren't available. All these information is well known in the aviation community and the responsibility of ensuring the airworthiness of aircrafts in Nigeria lies on us Nigerian. Not foreigners or anyone else. In this matter our useless, incompetent & corrupt government is to blame, not even Dana airlies.

Very stupid man. There was no business contract between him and the aircaft manufacturer or even the pilot. When you purchase a ticket to fly, the contract is between you and the airline, so Dana Air is the entity to sue. Even Dana Air cannot sure the manufacturer if they purchsed it from a third party, and not directly from the manufacturer. He obviously had no love for his wife, and only dreaming of becoming a millionaire out of this terrific misfortune. By the way, Boeing merged with McDonnel Douglas in 1997, so anyone wanting to sue the manufacturer should be suing Boeing.

This lawsuit is welcomed as part of the transparency process. It will force the inquiry to be more open and transparent, Boeing as part of their defense will need to gather information on the service record of this plane and proof no wrong doing on their part. Reducing the risk of a cover up in Nigeria. As we all know, GEJ has made so many promises that never saw the light of day. once money exchanges hands everything will be swept under the carpet. But a lawsuit overseas will prevent this. In Nigeria we dont have a judicial system. Justice is only for the highest bidder.

the plane is over 22 years old. i suspect the manufaturers dont even remember that they manufactured that plane anymore (just kidding). but seriously, i understand the man's pain, but his grouse should be with the airline company not the manufacturers. Dana airlines have obviously been negligent, and their negligence has nothing to do with boeing/mcdonnell-douglas. the manufacturers can assist in determining what Dana did wrong,but certainly can not be held accountable.if it was a mechanical fault that occured outside the normal scope, then by all means the manufacurers will be liable, but, we all know that lots of that model have flown for years without indicent. Dana were very negligent, and should be gone after.

Boeing doesnt even make jet engines, but i think its a good move, because that will put international pressure on finding the truth behind the cause of the crash. I think the man made a very strategic move even though he is experiencing so much personal grief.

How old is this man?We may need to know before even giving is actions some look or commenting on same.He is to me immature and perhaps a conman.He has just lost someone suppossedly dear to him and the best he could do on impulse other than being sobber and mourn his wife's death is to head for the court to claim damages in form of cash.Mr Allison,I sincerely condole you on the loss but your action leaves much to be desired.I sense greed and some opprtunistic tendencies in it.

Why on earth are there people here saying that suing the makers of the plane is the right move? ARE YOU ALL THAT IGNORANT? Boeing makes the plane and the engines, they DO NOT tell you to fly the plane when the plane as been written off or has not been passed to fly. Know your righs II

- No one is the judge here. Let them go to court and sort it out. Boeing is not a nigerian entity that can buy any ruling neither is can the man.
- Don't judge the man. The timing may never be right to you nor I but that's our own opinion. over 150 people that died would never take the flight if they knew it wasn't sound.
- Any one who had any connection with the flight can be sued even to the radio operator who did not demand that pilot go to Ibadan. His opinion is enough to land him in jail.

Know your rights

Nigerians are so ignorant that they don't know their rights. I live in Europe and since I left the shores of Nigeria, I had better undrestanding about my rights and that I should not allow myself intimidated over nothing.
Many comments are based on fear and ignorance.
- Boeing is NEVER too big to be sued. They are not Nigerian senators or govenrment who are bigger than a state.
- Boeing manufactired the aircraft and its parts and gave a warranty for a certian number of years. If that number of years is not past, then it can be sued.

More Suits

Allison, you've got the right to take legal action against the manufacturers, and possibly the pilot/co-pilot on the ground of negligence. I think your strategy to sue the pilot is to bring Dana into the suit proper. If thats the aim, then you need to also institute another suit against Dana, Minster of Aviation, FGN, The President of Nigeria, the Nigerian Aviation Authroity. You need good money to hire the best lawyers to handle this case! My advice is to pursue a strong case against the Avaition Authority and The Ministry of Aviation associated with the certification of the crashed Aircraft and that issued operating license to Dana. I think the government in power should be made to answer for this disaster.

The husband can only sue people and businesses with US connections. That is why he can only sue the manufacturer and pilot who are US-based but not Dana which is Nigers-based Internet..
