Nigerian Child Care Worker, Jessica Tata, Sentenced To 80 Years In Jail Over Felony Murder Case
Appeals for leniency failed to move a Texas judge who delivered a harsh sentence of 80 years behind bars for Nigerian-American Jessica Tata, convicted in the death of a child killed in a fire at her home day care in Houston, Texas.
Eight witnesses testified for Tata in the punishment phase of the trial on Friday. Twenty two witnesses testified for the prosecution, alleging that she ran an unclean facility where dirty diapers and vomit were strewn on the floor. The deceased child, 16-month-old Elias Castillo, succumbed to a fire ignited when Tata went shopping and left a pan of oil cooking on the stove.
The incident, which took place in February 2011, also left three other children seriously injured.
During the trial which began Oct. 24, surveillance video was presented that showed her shopping at Target just before the fire occurred. A former Target manager told jurors that Tata did not seem to be in a hurry even after realizing she had left the stove top burner on while the kids were at the day care.
Neighbors testified they heard the children crying during their unsuccessful attempts to rescue them from the blaze. Parents of the children who died or were injured told jurors they had trusted Tata, believing she was qualified.
Tata's attorneys say she never intended to hurt the children, who ranged in age from 16 months to 3 years old, and that she tried to save them.
Among those testifying at the trial was Jessica’s sister Jennifer who defended her sibling but acknowledged she was “hard to handle” as a teenager and didn’t get along with their parents.
Tata fled to Nigeria after the fire but was captured there after about a month and returned to the U.S. in March 2011. She has remained jailed since then. Tata was born in the U.S. but has Nigerian citizenship.
Her brother, Ronald Tata, told jurors it was his idea for his sister to go to Nigeria to get advice from their father, who lived there. He said their mother didn't want his sister to go because "it would look bad."
Ronald Tata said his sister should be held accountable for what she did, but he also asked the jury for mercy. "I believe in justice and not vengeance," he said.
Tata also faces three additional felony murder counts and other charges in relation to the other children killed and injured in the fire.
I fail to understand how this
I fail to understand how this lady could have been convicted of murder. My understanding is that you require intent and motive to convict a person of murder. Neither of these is present here. Manslaughter would have been more appropriate in my view. But then, this is Texas where strange things happen.

The problem with some people is that they tend to forget where they live. The first priority of any traveler is recognizing the laws and rules of where you are and act acordingly to those laws and rules. Secondly, America is worst country to establish childcare business. In America, children and women are well protected by law. If tata were to be a white women she would have see some leniency, but in a racist country like America where been black is automatic 10yrs behind bar, been African or Nigerian is 10x10, it is like pouring oil into fire. the white jurors will hate to see your black faec. Amodou Diallo was shot 42 times, all white juries aquit the all the officers. Tata mistakes starts with her choice of business. I will sell you stuff but i will never take care of your child. This is America.

Don't mess with Texas. Tata picked a wrong state to commit this atrocity. Running away to Nigeria was probably the nail in the coffin for her. Sad for a youmg woman with so much promises. I think this was a terrible accident but not murder. But then I am not the parent of those dead kids. Anyway you cut it, it is sad all-round. Some people has asked, " why the harsh sentence?', and I ask why not? There lies the dilemma of this terrible case. As for Nigerian thieving politicians these are the type of sentences they should be getting. Instead of extraditions of their citizens, Nigerian Government should be busy locking up all the thieves and murderers around them. Did someone say Boko haram? By the way I have no quarrel with the Government for sending Tata to America to face justice.

As for this "daycare operation", if I were the parents of that child, I would find her myself and kill her with my bare hands. 80 years looks good on her, especially since she probably believed that by running away and hiding in Nigeria she would be above the law. Surprise!! Enjoy life behind bars!

Hope this is reviewed. In as much as I don;t support her carelessness while on duty, it is a jumbo sentence and unthinkable that the offence could be weighty to attract 80 solid years behind bars!So those who have died of poverty inflicted upon them by the activities of oil multinationals in Nigeria,like spillage should be jailed for at least for 2 millennium! I hope she will be allowed to get married while in prison and make children who will remember her before she leave the world because before she comes out, grey hair will have filled her head! This jail term depicts racism not justice. It can only happen to a Nigerian because the country does not give a damn about her citizens. A few years ago in Ikorodu here in Lagos, Chinese industrialists locked-in scores of young Nigerian factory workers on night shift and went away with the keys to a night party. The fire outbreak in the factory that night consumed scores of these young boys. Nigeria did nothing. Our lives are cheaper than that of a chicken! Jessica Tata made a mistake, ran home for protection & possible reduction of her jail term. We picked her & threw back at her assalants. If this is what a country can do to her citizens, who needs one!

The sentence was TOO harsh. They should have considered her action or inaction a mistake due to poor judgement and not deliberate action. Her Lawyer didn't mount vigorous defence, and her Brother /Sisters by their testimony didn't help this woman. Too bad!

80 years is too much jo. could be anybody. who hasnt made mistake before? sure maybe because she fled. but still its too much. I hope she can be released on parole early ! My prayers are with her ..as well as the deceased. A real tragedy !

This is so laughable, she traveled down to Nigeria to seek advice from her father,she must be a global trotter. Nga is what she deserves though 80yrs is too much but she deserves some time in the coolers.

Very sad indeed. I hope both sides get closure through this trying times.In the end, four kids are dead and a young lady lost her life to 80 years behind bars as consequence to her irreparable mistake. No winners!!!

I believe 80 years is too much. 5 years would have been justice, but 80 years to me is hate and vengeance...There is another issue here which I would like to speak to. That the lady was captured in Nigeria (where she is citizen), and sent back to the US without the Nigerian govt first negotiating to tamper justice with mercy, speaks to how irresponsible our government is. If it were to be a US citizen running home for refuge after what was obviously an unintended accident, the US would use every legal argument in the books to protect their citizen. If eventually they agree to repatriate such person for trial, it would be after a very very long series of negotiations with the other country to ensure that the weight of justice is fair. Shame on Goodluck Jonathan.
