Oluyinka Oyeniji, a Lagos-based lawyer, has dragged President Goodluck Jonathan and the Attorney-General of the Federation to court over the renaming of the University of Lagos. 

The suit, FHC/L/CS/575/2012, was filed this evening at the Federal High Court in Ikoyi, Lagos, and it seeks the court's interpretation of the 1967 Act establishing the University of Lagos.

Mr. Oyeniji, who is also a Masters Degree student of the University of Lagos, is requesting the court to interpret four questions:

-Whether the President is empowered under the University of Lagos Act 1962 amended in 1967 and as contained in Chapter U9 Laws of the Federation of Nigeria 2004 as amended, to change the name of the University;

-Whether the action of the President by declaring in his broadcast that the name of the University is ultra - vires the provisions of the Act establishing the University and therefore null and void and of no effect;

-Whether the action of the President by declaring in his broadcast that the name of the University be changed is a breach of the doctrine of separation of powers which Nigeria practices under its Presidential System of Government; and

-Whether the Honourable Court should, in the circumstances reverse the name of the University to its original state being the name with which the Act establishing it provided for in its long title, short title, interpretation section and the entire body of the Act.

In his Democracy Day broadcast on Tuesday, President said he was changing the name of the university to Moshood Abiola University.  That has sparked outrage among students, alumni, organizations and citizens since then.  Demonstrations at the university have led to its being shut down for two weeks.

Renaming Unilag

You sound like an uneducated moron.
Who is the federal government? An elected administrator to placed in office to act on behalf of its people ie a servant of the people.

The university belongs to the Nigerian people and not to the servants in office. Therefore those servants do not do as they please, they consult and get the go ahead to make changes that the people want. They respect and act accoprding to constititions, be it the university consistution of the national constitution.

The federal government has the full power to change the institutiö's name. Afterall, the institution belongs to the federal government. The students are all passing-by, they are all strangers and the school is not their own. We are in the presidential system of Government so the president has the power to do that!

I am, in fact, now convinced and certain that the action is doomed to fail as it is premature, lacks merit, and it does not disclose any cause of action. It is also most certain to fail on grounds that the claimant lacks the necessary Locus to bring the action.

In our haste to rush to court, we omit the finer details of English Language. The name change has not yet been EFFECTED, but has been pronounced. Yet this gentleman and my 'learned friend' rushes to court to be embarrassed. Do people not have shame?

Lagos State AG says Fed Govt has the power to do so!

"THE Lagos State Attorney-General and Commissioner for Justice, Mr Ade Ipaye, on Thursday, said contrary to various comments trailing the recent change of name of the University of Lagos (UNILAG) to Moshood Abiola University, the Federal Government has the power to do so.

He, however, added that the Federal Government could only effect the change if the law that was enacted in creating the previous name was changed".

Professor Okojie noted that what the president did was not strange, as other institutions had similarly been renamed in the past, saying, “We are familiar with these issues. I have been in the university system for this long. I speak as Executive Secretary of NUC and a regulator of universities.

“We have heard Ife (Obafemi Awolowo University) changed in 1987. We have heard University of Sokoto now Uthman Dan Fodio; we have heard Yola, Modibbo Adamawa; we have Nnamdi Azikiwe which was University of Awka before. This is about the seventh.

“The president had announced that we want to honour Abiola on Democracy Day which everybody thinks is in order.

Honour to whom honour is due

I find it difficult to understand why University of Lagos students are up in arms against the renaming of the institution in honour of a great Nigerian. Late Chief M. K. O Abiola has a better international brand than the university. Nobody knows Unilag beyond the borders of Nigeria but I have come across many people in foreign lands who are familiar with the name, M.K.O Abiola.
These students and their lecturers should gear efforts at building a brand out of academic excellence and not on a name which currently stands for nothing.

I have a feeling that those of you abusing the Yorubas and supporting MAUL or MAULAG or whatever are just carrying bad belle.what has this got to do with tribe,when will we grow beyond this tribalistic jealousy. I didn't attend UNILAG but I know that it is the Legislative arm of Government that makes the law and not the executive arm. The case filed by the lawyers should also oblige the court to take. Into account the huge cost involved, whether the federal government will bear the cost to rename the institution.

The right way!

While I applaud any civil action or parameter or any other civilised way to protest or deal with any grievances, but I suspect that the court will throw that usual phrase, 'No locus standi', at him, and he would have wasted his time, money and effort. Except, of course, he is merely grandstanding.

At that time I will ask or remark, I wonder why these Lawyers don't ever learn.

Youths they say are the leaders of tomorrow. To be leaders we have to be united yet I see us being divided. How long are we going to let one man's insanity bring us all down? The renaming of the University of Lagos to MKO Abiola University should have been done with consultation of and agreement by the students, alumni and school authority especially under the current democratic rule we are trying to practice.

The President should have a listening ear and please rescind the name change decision for the interest of the school's autonomy and the undeserved bad repute MKO's name is being smothered with by the ongoing public reactions.
