Subsidy Fraud: Court Fixes Trial of Sons Of PDP Bigwigs Tukur, Ali And Businessman Arisekola-Alao

A High Court sitting in Ikeja, Lagos today fixed the 6th and 7th of May 2013 for the trial of Mahmud Tukur, son of the National Chairman of the Peoples Democratic Party, Bamanga Tukur; Mamman Ali, son of the former National Chairman of the Party, Ahmadu Ali; and Abdullahi Arisekola-Alao, the son of Ibadan based businessman, Abdulazeez Arisekola-Alao.

 

They are to be tried for charges of defrauding the Petroleum Support Fund of about N1.899bn.

 

Another man, Alex Ochonogo, as well as Eterna Oil and Gas Plc, were arraigned along with them for obtaining the nearly N2bn from the Subsidy Support Fund although they had not imported even one liter of the Premium Motor Spirit.

 

Abdulahi Arisekola-Alao’s application for the return of his international passport, which was earlier seized by the court as part of measures to ensure that the suspects did not escape trial was granted.  He told the court that he needed to travel to take care of his sick son in the United States, and that he would be away for 30 days and return well before his trial date.  

 

The EFCC lawyer did not oppose his application, saying that his availability for trial was the important factor for the prosecution team.

 

Mahmud Tukur also indicated he would apply for his own travel passport on business grounds.

 

In August last year, both men had also applied to an interim judge, Justice Lateefat Folami for leave to travel.  Their trial judge, Justice Adeniyi Onigbanjo, was on leave at the time. 

 

That application was turned down by the Justice Folami, who insisted that the trial judge’s rule which adjourned their matter before his leave would rule on their application upon his return.

 

Apart from the N1.899bn fraud for which Abdulahi, Mahmud and Ochonogo are being jointly tried before Justice Adeniyi Onigbanjo, Abdulahi and his company, Axenergy Limited, also separately face seven counts of subsidy fraud amounting to N1.472bn. before another judge, Justice Habeeb Abiru.

 

Justice Onigbanjo has fixed May 6th and 7th for the trial of the trio.

Another Film-trick!!

Ahmadu Ali, Bamanga Tukur, Arisekola-Alao, sounds like the opening stanza of a song about all that is wrong with this nation!!
Like one of the commentators pointed out, the smiling faces of those young crooks might be annoying, but that of the EFCC man's is downright appalling!!
Imagine a police prosecutor smiling so contentedly with a poor fella raided and charged for wandering, cause he could not afford an imposed #500 bail. Never!
Actually in saner climes, their parents would have resigned from their public positions, but in Nigeria, it is a bragging right to have your son take after you as a high-thief!

The Law and Judicial System need serious overhauling!

We are now beginning to see the uselessness of some Nigerian laws and court procedures in Nigeria! Big men, using smart and costly lawyers, exploit these loopholes and go scot-free after committing serious offences, while poor offenders have the full weight of the law on them. Sometimes the judge is not to blame, like in the Police Pension Theft case. The law prescribed the punishment and this was what the judge delivered. The judge does not make laws. Serious cases like that and the present fuel subsidy case should be looked into with a view to making laws granting punishment that is proportionate, otherwise we are just fooling around with corruption. As for the pension theft case, the man is 'lucky' because making the offence punishable with life would not affect him because of the principle of non-retroactivity of law!

I'm Watching

If the Law Enforcement & Justice departments do not do the jobs they are supposed to do, then I will have to move and shake things into place speedily.

EFCC is a noise maker !

EFCC official expression says it all

I am more disturbed by the expression of the EFCC official than the alleged criminals he is meant to look after.
It seems to me he is rather excited. Perhaps sharing a joke or two with the culprits.

I have no doubt these cases will be dead on arrival. Which judge will convict the children of the high and mighty in Nigeria with pdp and Jonathan at the helm of affairs. Enjoy the drama while it lasts. Those kids already have the final judgement, so save yourself the headache of following a dead case.

ARISEKOLA -ALAO and OBA OTUDEKO have been boasting that nothing negatively will happen in any Nigerian court to them on the FUEL SUBSIDY SCAM as whoever ( Judges ) that will sit on their cases will be spoken to from Abuja.

Until we rise up and claim back our country from these crooks, Nigeria, as a country is gone.
