Sylva Bayelsa Governorship: Supreme Court Adjourns Appeal Until After Governorship Election
The Supreme Court of Nigeria will next April tell former Bayelsa governor, Timipre Sylva, whether or not he has a place in a gubernatorial election that would have been concluded one full month earlier, and for which he had brought the appeal in the first place.
Yesterday, after listening to lawyers, the court promptly adjourned further hearing in the case until April in what seems to be a substantive decision in itself.
Also of note yesterday, is that the Chief Justice of Nigeria (CJN) Justice Dahiru Musdapher recused himself and did not participate in the hearing. He chose Justice Mahmud Mohammed to chair the panel that heard the case.
SaharaReporters had two days ago revealed a plot between President Goodluck Jonathan and the CJN to scuttle any further challenge to the candidacy of Seriake Dickson, his handpicked candidate for governor.
CJN Musdapher has been promised an extension of his tenure by 5 years via a constitutional amendment that will extend the retirement age of Supreme Court justices from 70 to 75 years. It is unclear, however, how this could possibly happen, given the intricacies of constitutional amendments. Besides, Justice Musdapher is billed to retire in July 2012, just five months away.
With yesterday’s adjournment, Mr. Sylva's candidacy has been effectively and permanently shut down, at least for now.
Next Saturday, February 11, the people of Bayelsa will engage in a sham election. Jonathan's candidate, Mr. Dickson, is expected to win easily.
2012 has not been a good year for Sylva. On January 27, he was one of the five governors dismissed from office by the Supreme Court which ruled that their legal mandate ended in May 2011. On January 30, electoral commission finally shut him out of next Saturday’s governorship election in the state, saying that only the party candidates that emerged after the Court of Appeal judgment of Friday, April 15, 2011 would be eligible to stand in that race.
Sylva argues that he should be the Peoples Democratic Party having emerged as its candidate at the January 2011 governorship primaries.
reply
Other governors should be careful because jona fit manipulate your state
Well done supreme court
This is a governor who explicitly disobeyed an order of a high court in PH directing him to reinstate the former deputy governor Ebebi. Now he is now seeking favour through that same channel. I trust the judiciary cos they know how to deal with such politicians.
the courts may be truly too busy!
Why condemn the court? There is so much room for all the litigations coming up everywhere in the country. They can be fully booked and the only space available to entertain the appeal may indeed be after the elections have taken place, but sorry, that is the reality.
If they had agreed to schedule a court session in the night in order to entertain Sylva's appeal, same Sahara Reporters would have raise ruckus about "kangaroo judgement"
The beauty is that if they rule in his favor, they will simply ask that the election be conducted again before an interested party was duly denied his right. Let us be reasonable, it is not everything that has political undertone, sometimes reality cannot just make way for the events under discussion.

God bless bayelsa state
PDP will definitely win the election, no doubt about that. I only pray bayelsa grows up, cos after 16 years years after its creation, Bayelsa is still crawling
sylva
what do you expect from a drug addict, who is 24/7 high on cocaine bought with state money. Sylva was a curse not a blessing to bayelsa.
Do Nigerians from other
Do Nigerians from other states feel d impact of sylva's bad governance? He was about d worst governor in Nigeria. Those his praise singers, shame on u all. Well done Jona, u r really God sent!
Syvia's case
It was unfortunate that Bayelsa was grossly under-developed under Timipre. That notwithstanding, it should be blamed on the people themselves. Praise singers and criminal celebrators should be driven away from the government house if Bayelsa State is to witness any meaningful development.
There is no better time than now. Good luck to Bayelsans.
Mockery of our judiciary!
I know albeit painfully that Judgement these days in most of our courts are for the highest bidder! The CJN just committed a judicial harackiri. Granted that Sylver did not perform well, must our reverred judiciary be used as a merchant of destruction by the pesident? Why not use another means to deny sylver the PDP ticket than this crude means? It shows that our supreme court justices of these days are not as wise as the time of Eso,Oputa,Oguntade,Nnamani etc etc. Pathetic!Truely pathetic!!

dickson wake up yr progressive ideas-not time 4 Awugiri dance
This is not time to celebrate in bayelsa state. The task ahead of the state is great. Dickson has to be very careful. And not launch himself into awarding contracts to outsiders at the expsense of the indigenes of the state. Bayelsa has to reclaim her lost glory through hard work and sincerity of purpose. Like GEJ said, we shall team up with Bayelsans to chase Dickson out of the state if he derails. Every job in that state should go to the local people. Okilo and spiff did it without trouble! We have had enough of the insults and the digrace often brought unto the soul of ijaws by our leader in that Niger Delta. Its a shame that yrs after Sylva ruled that state, he left behind drug addicts, an increased number of HIV/AIDs patience, no drinking water, health, poor educational facilities, lack of electricity-paractically nothing to show for his 4 yrs of misrule-which OBJ gifted him with-we need a stable well focused adminstration-not a bunch of AWUGIRI dancers-
warning to dickson to bring back the lost glory of that state

Corrupt Jona and his rotten errand boys in the judiciary
The rotten old bastards in the judiciary should hand their wrinkled and ugly faces in shame. After collecting bribes from Dumbo Jona, Musdapher and his small gang of quacks want to hoodwink Nigerians. These rogues in the justice system should be the ones being targeted by Boko Haram and not innocent citizens. Their corruption is the root cause of the insecurity in our country. The moron pretending to be president is thoroughly evil. This clown keeps talking nonsense that he supports the rule of law but his criminal and undemocratic conduct does reveal him as a big and wicked liar.
Judges be careful
Nigerian judges should be careful of the judgment they pass as a result of self profit bcs God in heaven is always concerned with judgments. There is always a pay back from God for delibrate wrong judgment. Nigerian courts have become a complete mockrey of any judicial system in this world. Am not from Bayelsa. The wrath of God will not fail to decend on any judge who passes paid judgment in Nigeria
slyva;s case
His case is Divine Oriented,A man that was picked despite all odds turned himself to be a drug head,God never sleeps...There is nothing to show for in bayelsa(ZERO LEGACY)...God blesss the president.
slyva;s exclusion
he should go and sleep,he failed the people,,,,lets just have a change..
good bye
Good bye sylva.I hope you have made enough money to last you and your generations.
By the way where are your praise singers who always makes comments castigating the office of the president whenever sahara reporters and thisday write articles about u?
UNDERTAKERS
In Nigeria there is no judiciary, what we have is a mafia group acting as UNDERTAKERS for the fraudulent ruling party{PEOPLES DESPOTIC PARTY}with some shameless old men parading themselves as learned men.FASHISM is what is being practiced in NIGERIA and not DEMOCRACY.
I'm very sory silva, u hv now
I'm very sory silva, u hv now tasted d biternes of nigerian judiciary. I'm certain if u were 2 be dickson n a judgement goes against ur oponent u wil also celebrate. Supreme court judgment was delibratly deliverd becos jonathan cannot go 2 bayelsa if silvia is on governor seat, he feared d unknown that is why GEJ connived wit CJN nd gave judgment against d 5 governors. Dickson wil win, no doubt about that, even if he contested wit obama but by d God's grace GEJ end wil not be good, he is bayelsa's problem
bye bye sylva
bye bye sylva(cocaine head). hello Bayelsa
