EFCC Press Release- N600m Investment Scam: Court Remands Prominent Enugu Lawyer In Prison

A Federal High Court sitting in Enugu has ordered that prominent Enugu Lawyer, Barrister Christian Chukwudozie Ebuzoeme be remanded in prison custody till November 21 pending the hearing of his bail application.

The accused was arraigned before Justice Mohammed Shuaibu by the Economic and Financial Crimes Commission, EFCC on November 15, 2012 on a four count charge bordering on intent to obtain money by false pretence.

The accused and his accomplice, one Amaechi Okoye who is still at large, allegedly swindled unsuspecting members of the public through a phony investment scheme. They, in contravention of banking rules, floated a company, Karchack Services Limited in New Haven, Enugu through which they solicited and received deposits from members of the public with promise of mouth watery returns to the investors.

When the charge was read to Ebuzoeme, he pleaded not guilty, prompting prosecution counsel, Johnson Ojogbane to pray the court to fix a date for the commencement of trial. But defence counsel J.O. Agha moved a motion for bail, urging the court to admit his client to bail on the same terms which the EFCC had offered him an administrative bail.

Justice Shuaibu however rejected the oral application and adjourned the case to November 21, 2012 for hearing of the bail application.

Well, I don't know whether to start from the reporting or the comments. But let it be on record that J.O Agha never moved an oral application for bail. However, he tried to persuade the court to hear his application which was not ripe for hearing, on the ground that he did not expect prosecution to oppose because the accused is on administrative bail. Be that as it may, a close look at the Federal High Court Rules will shows that an oral application can be moved, although the facts in support of that Application must be on record through affidavit. It's too ugly that a reporter was present in court but could not relay simple facts. Let lawyers study the court rules closely before ranting.

EFCC nipped this in the bud. Apparently, the man wants to outsmart the Master Ponzi scam artist, Bernie Maddoff. They come in different professional guises, lawyers, accountants, investment consultants, etc. Good work, EFCC.

My Heart Bleeds

I am at pain to constantly read and watch how EFCC are chasing rats while the elephants are abound and roaming the terrain causing more destruction. In Nigeria context they are causing economic savagery and the lots. Okay, the case against the lawyer is a case of 419, and I subscribe to dishing out appropriate punishment to him if found guilty. But back to the real culprits of our economic woes and social disfranchisement and decadence - these criminals whose records of economic frauds and activities of self-aggrandisement and unprecedented kleptocratic empowerment are the main cause of the country's social delusion, misfit,conflict, turmoil resulting to current break down of law and order. These are the people that they should go after first arrest.

These Lawyers!

Why do Lawyers fail to properly move bail applications. By now Lawyers should know that most Judges reject oral bail applications, and should therefore, be prepared to make a written application. What does it cost them to take a written application with them to court?

Because of the Lawyer's shoddy work, his client will spend 1 more week in Jail. Not good enough!

I agree with the comment that bail appears to end prosecution of cases. He is right. EFCC and the whole administration of Justice sucks. Many examples abound, like Bankole, Iyabo, Kalu, Saraki, etc. Not good enough!
