Delta Gubernatorial Re-Run At The Supreme Court: With Justices Tabai, Mary Odili And Rhodes-Vivour On The Panel, Will There Be Justice?

The people of Delta State within and outside Nigeria who have been closely following the legal processes of the gubernatorial re-run elections are now deeply concerned  that, the miscarriage of justice which had characterized the case at the lower lection tribunals may not be different at the Supreme Court.

These concerns are amplified by the fact that the justices who have been selected—through a process reportedly facilitated by the Registrar of the Supreme Court—to sit on the case are all fraternal associates of Governor Uduaghan and his Ibori clique in Delta State and have, in one way or another, been beneficiaries of or lobbyists for the interest of the Peoples Democratic Party (PDP).

Further heightening these concerns is the blatant boast of the governor, at a recent meeting which he called barely a week ago ostensibly to dialogue with a group of people critical of his government, in which he was reported to have asserted that, as long as the courts are in Nigeria, he cannot be removed from office and that those who have taken him to court should face up to that reality.  That meeting was reported by SaharaReporters and some of the governor’s comments are on Facebook.

But to understand the motivation for Uduaghan’s confidence and apparent certainty of the Supreme Court outcome, here are some of the facts about these justices that the people of Delta State should have good reasons to be worried about.

1. Justice Francis Tabai: He is from Delta State and has been very close to the state government. Although he is entitled to benefits as an indigene of the state, by seeking favours from the government on behalf of his children there are serious undeclared ethical conflicts of interest concerning the fact that he is now going to preside over the case of a governor to whom he consequently owes possible requiting of previous favours. He has just recently received an award from Governor Uduaghan and he is Pro-Chancellor And Chairman Of Council, Delta State University, Abraka. As pictures do not lie, the whole world can see the tagged picture of Justice Tabai and Gov. Uduaghan together below. As a matter of personal honor, Justice Tabai ought to have declined being on the panel. How will the course of justice be served with the presence of Justice Tabai in this panel?

 2. Justice Mary Odili: It is common knowledge that she is the wife of ex-governor Odili of Rivers state. She is part and parcel of the PDP political establishment and has benefited immensely from the system. Her meteoric rise in the Judiciary came with the ascension of her husband as a governor. In retrospect, she used her influence while at the Appeal Court to give judicial seal to the unlawful substitution of current Governor Amechi, which led to the friction between the Supreme Court and the Court of Appeal. Those close to her say an opposition party can never win a case against the ruling party if she is part of such a case at any point. In fact, there are strong claims that it is mainly due to her powerful influence in the judiciary which has made it possible for her ex-governor husband to enjoy perpetual immunity from prosecution that he is currently covered by, unlike other ex-governors.  At the very least, the appearance of a conflict of interest should have disqualified her from sitting on this case.

3. Justice Bode Rhodes-Vivour: He is no doubt a sound and brilliant judge who was well-respected until the Olabode George case, a  case involving another PDP chieftain, in which he (Justice Vivour) was alleged to have put tremendous pressure on the most respected High Court judge, Justice Oyewole of lkeja High Court to free  Chief Bode George. Here again, the sympathy is to a well known man of PDP.

From the foregoing it can be deduced that three justices in the Delta Re-Run election case at the Supreme Court are either clear loyalists, associates or lobbyists of the PDP, and with such antecedents it is a profound cause for concern, by the people of Delta State, who have witnessed a string of miscarriages of justice since the time of Ibori, and now may have to suffer the same parody of justice as justices with a track record of jaundiced partisanship regarding election cases involving the PDP are now lined up to decide on the Delta Re-run case with one of their favoured fraternal associates, Governor Uduaghan as a person of interest in the case.
Perhaps there is little wonder then why Governor Uduaghan is boasting that as far as the courts are concerned he has no cause to worry?

Great Ogboru is a coward

Great is so selfish (poor leadership quality), he abandoned his family and his supporters, first 1990, then in 2003 and then in 2007 to save and enjoy himself in London and Europe. I never knew he was a wanted man. When the Elders put out a press release looking for him in 2007, i should have known better,but he was busy enjoying Champagne and Remy at the Metropole Hilton in london. June, July 2007, I was with him and i bore the brunt of his anger at the hotel and my flat. I guess losing the election got to him. One of his sons was graduating that summer in nottingham and he never attended his graduation,how sad. He left me with one of his mobile phones from Nigeria. I have been intimidated and harrassed because of my connection to him and what i know. My God is greater than selfish cowards. Great is litigious and bitter.

RERUN ELECTIONS

This is a very wise move from the Chief Justice. We should also consider the fact, that when a person is convicted for a criminal offence, that person is given credit for the period, he or she is in lawful custody or if not convicted could be given compensation for the period in lcustody, if that person ask for it. I believe that it is right, to give them the time to serve as governors, for the periods that they did not serve, on account of the judgements or should be punished for the period they served, if their elections were illegal on account of their acts and so declared by the courts

A serving Supreme Court Judge a Pro-Chancellor of a University?

It's unimaginable that a serving Supreme Court Judge is a Chairman and Pro-Chancellor of a University. This is how our judiciary has sunk . Go to Delsu and see the claims that Justice Tabai makes monthly and which the poor and under developed university pays him. Nigeria is finished.

Have you any idea when this panel of judges will sit at the Supreme Court to pronounce on Ogboru's final challenge of the Governorship Election in Delta State held last April. Would the analysis of the forensic examination of the ballot papers be used in evidence by the legal team of Ogboru? Anyone with information, please help.
