VIDEO: Governor Oshiomhole's Gross Abuse Of Power

On Monday Governor Adams Oshiomhole of Edo state ran to the scene of a demolition exercise in Benin city. The governor visited the site to see how some controversial demolition was executed by the state Task Force on Demolition of Illegal Properties.

Apparently angered by some demolitions that he claimed was mischievously done by the team Mr. Oshiomhole publicly scolded Major Lawrence Loye, the task force chair. As it turned out, Major Loye and his team had demolished buildings belonging to the former governor of the state, Samuel Ogbemudia and a former senator, Roland Owei. Both men are strong political"heavyweights with close links to the governor.
 

As shown in this video, Governor Oshiomhole not only scolded the task force chair but ordered him arrested, arbitrarily. Major Loye was arrested for carrying out his duties in the state.

totally disappointed with Saharareporters. Your caption is most misleading. How did Oshimole Abuse power? ok because he said the major should be arrested?......haba.
It is clear from your video that the major was not doing his job properly. whether it is his fault or not the destruction was done by his men, then who bears the cost of his mistake. he has to face the rot of his misdeeds.

Major Loye's duty?

Major Loye was arrested for carrying out his duties in the state.

Why blame governor Oshiomhole? Why dont you blame Nigria government who at 50 and uptill this 22nd century have not waken up to restructure how they operate in nigeria? No body's house should be demolished in any civilized society, especially if it does not block any government project, even if it does, it should be worked around. Also, the so called major should have consulted with the owner of the house before satanisizing oshomhole's government, or better still do some profitable to all Edo state citizens and stop demolishing people's homes. It is satanic, even the gods and their ancestors may not forgive that Major Loye.

Please, stop labelling Oshomhole as abusing his power. Use a more friendly constructive sentence structure.

The Governor is not for justice and equity. Simply because the demolition has affected some influential people in the state ,he decided to disgrace and arrest the major.What about the common man whose only property/house was demolished? Does anyone care? This is usually the case in our society,"oppress the poor no problem but if you dare the rich you pay the price". The governor should have taken this man's background into consideration (Rtd Major)before taking this action. The policemen were too happy to carry out the arrest in a very dehumanising way in order to please the gov. If the Major's cup is full like the gov said, why then was he allowed to stay on. He should have been fired a long time ago when the cup was half full."the man is a sadist". "he wants to cause confusion in the state." Haba Sir. I do not think so.

Re Demolition of illegal structure

Mr comrade or Governor Oshiomole,l have always regarded you with high esteem. But watching that vedeo clip, l'm afraid my impression of you is completely and utterly misplaced. It shows you are a man without sense of civility and decency. In the first place, where is your administrative sense of professionalism. All that you have demonstrated in the full glee of the public is administrative tyrany and bully. Because BIG MAN is involve, Gov Oshiomole ran to the scene. What about all those poor people houses that were destroyed arbitrarily and which the Governor is aware. 'your cup is full' Was this illegal arrest not staged managed? No reprimand, no warning. It is undemocratic. The Governor has allow his anger to over take his common sense. The Comrade Governor acted in good faith and within the ambits of the law. i believe the petitions against the said Major are numerous becuase he has used his office to oppress and extort the people incessantly.The Governor is the Chief Security Office of the state and also like everybody else can call on the police to make arrest. the humiliation suffered by Major Oloye was in the hands of the over-zealous police officers and not the Governor...The Governor did the right thing in the circumstance especially considering the colossal destruction done by this Sadistic man

Gov.Oshiomole definitely has good intentions but to treat the Major the way he did was quite uncouth and borders on incivility.He should have relieved him of his position,Period.The shameful display in front of the cameras was totally uncalled for.

WRONGFUL SEIZURE, CITIZEN ARREST NOT A VIABLE EXCUSE!

Anybody who makes a citizen arrest takes the risk of being sued either for civil liabilities or prosecuted for the violation of a criminal statues. Civil actions can be for; false imprisonment, intentional infliction of emotional distress and wrongful arrest.
Criminal liabilities includes; kidnapping, impersonating a law enforcement officer etc. Have sanction can easily be the result of such an action, especially, if the fundamental civil rights of the arrested person is violated. Oshiomhole is in for a long haul!
Moreover, citizen arrest is only a viable option where there is a high risk of flight, or to prevent destruction of evidence, or to prevent concealment of evident and so on. None of the viable reasons for such arrest is tenable here. Major is a highly responsible citizen, that was not running away from court summon. There was no safety issue concerned. Oshiomhole acted improperly by arrogating to himself powers that he does not have.

THE GOVERNOR ONLY ACTED TO DEFEND THE DEFENSELESS!

Oshiomole acted only to protect the defenseless in Edo. It is true that two wrongs don't make a right. Given a lawful society, what Oshiomole did was a gross abuse of power.

This episode is akin to what transpired in Borno, where JTF soildiers murdered innocent citizens for a bomb blast that was never investigated. Imagine Jonathan arresting the soildiers and saying they must be brought to justice? You and I know it will never happen. It is God for us all, every man to himself.

In a society where rule of law is an untestable hypotheses, Oshiomole acted in good faith.

I thought this Oshiomole guy

I thought this Oshiomole guy was civilized, but he just proved that he lacked class. Apperently there are idiots are supporting him. EVEN if 'Major' committed an unlawful act, should that translate to a governor becoming the victim, jury, judge and whatever. And telling this guy that his cup was full. Come on, he is the governor and could have fired this guy if he thought he wasn't doing his job right. I suspect the owner of the property has a connection to this Oshi-hole guy, hence his embarrassing of this guy. Oshi is a damned fool.

The Governor is fully entitled to make a "citizen arrest"

The governor and any citizen have the constitutional power to effect a "citizen arrest" when a crime is been committed witnessed by such citizen making the arrest. After a citizen arrest is made, the police is called, the culprit to such crime is then "de-arrested" and handed over to the police to make thorough investigation into the alleged crime. The governor was duly and legally obliged to carry out an arrest if he witnesses a crime being committed, which he rightly did. He's a very clever man, most likely far more intelligent than the erring major. The police were present when the major was being grilled by the governor. I won't be surprised if the police were taking note of the entire conversation. Well done comrade!!!

I am totally disgusted at the comments I am reading here, justifying the governor's action. There is no justification whatsoever for the governor to treat the major this way even if he is a criminal. It is shameful and completely unacceptable. We are not animals and I wonder why Nigerians cannot respect and treat others with dignity. You do not put a fellow human being in the back of a truck like a goat. This is pure abuse of power and a total disregard of humanity. I am ashamed.

Jungle justice for jungle animals. This is the only way some Nigerians understand. I am sure it wasn't the Majors first time. Did you hear the Gov sayi your cup is now full Major. Even if a house or houses were marked for demolition by another team, I beilieve that there are procedures in place to do final checks before a demolition/s are carried out. All these are political moves on both sides. This man could not have been in the army. This is a serious crime although he should not have been handcuffed. He should have been arrested in another way. Unfortunately the action is a deterrent to some thick skulls that go round doing bad things in Nigeria in the name of the government.

Another shameful face of Nigerian leaders!

Gov Oshiomole has abused his authority and has just demonstrated what some of us have always suspected him to be: a usurper who masquerades as a champion of the people! This is shameful and can only happen in Nigeria! For those who don't know, this is the beginning of tyrnanny. A situation where a civilian governor turns himself into the judge, jury and the jailor is nothing but total abuse of power. I beg to differ from all the paid liars talking legal jargons over this common sense. To think that the man is a serving Major of the Nigerian army makes this situation so shameful! Mr Governor sir, you may have good intentions but honestly you went too far on this. I belived the man was trying to do his job without treating some citizens (like Frm Governor Ogbemudia) as sacred cows beside he said the property was marked for demolition by the Town planners, maybe or lets asume he made a mistake by not getting your final approval before carying out the action then i think you should have sacked him or charged him with some sense of respect. Gov Adam of Edo State is protecting himself

 Does it suprise anyone that this governor was humiliating this guy publicly and making sure that its been captured on camera? This is Nigeria works! The house of some political heavy weights were brought down by this guy and the governor had to make a public display of him to pacify his masters. This is the man who was said to be God sent to rescue Edo State?

The apprehension or seizure of a person through arrest is such a big thing that the constitution provided procedural safeguards for the significant deprivation of freedom.
A situation where a civilian governor is given unfettered discretion as to when and for what to order the arrest of a citizen is a prelude to total anarchy. Yes, the police NOT the governor can arrest for a misdemeanor committed in their presence or a felony where probable course exists that the person committed a felony.
What Major negligence, a place was marked he for demolition, there was no clear instruction that the demolition mark is for decoration. Major proceeded to order a demolition. Where is the crime? At worst he can be said to have abused his office, still not a crime.
