David Mark’s Petition Suffers Setback-PM News

February 7, 2008
Senate President, David Mark this morning lost his bid to reopen hearing on the petition against him by his ANPP challenger, Alh. Usman Abubakar, over allegation of falsification of exhibits tendered at the tribunal.

Mark had on 23 January this year, filed a motion through his counsel, Damian Dodo (SAN) asking the tribunal to open the case for hearing to enable him prove that the election results form EC8A were massively tampered with by the petitioner.

In the ruling this morning, the tribunal said the motion lacked merit because Mark could not prove in his affidavit that the alleged falsification was carried out while the exhibits were in the custody of the tribunal, and that there were contradictions between him and INEC as to where the alleged fraud took place.

INEC had earlier filed a similar motion, for which the senator followed suit.

However, counsels to Mark and INEC accepted the tribunal’s ruling, thus paving the way for the adoption of the parties’ final address.
