Court of Appeal in Benin City delays ruling on Uduaghan election as judges bicker over bribe

As of 4 PM Nigerian time today in Benin City, the Elections Appeal Tribunal handling the case between the Delta State governor, Emmanuel Udughan of the People’s Democratic Party and the Action Congress candidate, Peter Okocha, was still being awaited in the court chambers to deliver the scheduled ruling on the case arising from the 2007 gubernatorial contest.

As of 4 PM Nigerian time today in Benin City, the Elections Appeal Tribunal handling the case between the Delta State governor, Emmanuel Udughan of the People’s Democratic Party and the Action Congress candidate, Peter Okocha, was still being awaited in the court chambers to deliver the scheduled ruling on the case arising from the 2007 gubernatorial contest.
The five-man panel headed by Justice Monita Dongban-Mensem , according to sources, could not deliver the judgement in the case as a serious disagreement has arisen over the decision of two of the judges to rewrite the ruling earlier reported to be in favor of the annulment of Uduaghan’s election.

Two commissioners working for Governor Uduaghan, Ovuzorie Macaulay, the Commissioner in charge of Power and Energy, and George Orogun, the Commissioner for Finance, allegedly  approached two of the judges with N2 billion each to take care of the members of the panel, but it seems the bribe was rejected by some because they were offended, or thought they might have been shortchanged.

The five judges: Justice Dongban-Mensan, Justice Hussein Muhktar, Justice Olukayode Ariwoola, Justice Oyebisi Omoleye, and Justice Chima Nweze finally arrived the venue at 4:30 PM Nigerian time, just as this report was being filed.

The Tribunal has just concluded its rulung in favor of Governor Udughan.
