A lower tribunal had nullified his election in November.  Justice Mairo M Mohammed J. C.A leading three others had nullified Mr. Dakingari's election on the ground that the Independent National Electoral Commission (INEC)  did not provide the statutory Distribution Forms for the election.

However, an appellate panel today reversed the decision of the lower tribunal which made an order for fresh elections in 90-days. The decision today also  ends the planned election except the Supreme Court upturns the appeal.

Dakingari is late president Umaru Yar'Adua's son-in-law, his third wife is Yar'Adua's second eldest daughter, Zainab.
