Justice Walter Onnoghen leading other justices stated that the Appeals Court erred in law when it deferred the reasons on its judgement to outside the 60 days allowed by the constitution of Nigeria.

The court thereafter ordered INEC to conduct fresh election in the state within 90 days.

The lower tribunal had nullified Mr. Dakingari's election on the ground that the Independent National Electoral Commission (INEC) did not provide the statutory Distribution Forms for the election.

By today's ruling the Supreme Court  ordered another election in 90-days. Mr. Dakingari would probably win the re-run because the ruling party typically wins such election rerun aided by INEC and police

Dakingari is late president Umaru Yar'Adua's son-in-law, his third wife is Yar'Adua's second eldest daughter, Zainab.
