Nigerian Court Of Appeal Orders Striking University Lecturers, ASUU To Resume Work Immediately

The Court of Appeal sitting in Abuja has ordered members of the Academic Staff Union of Universities (ASUU) to end its seven-month-old strike and resume work with immediate effect.

Following the federal government’s lawsuit at the National Industrial Court (NIC) against ASUU, the court on September 21, granted interlocutory order in favour of the government and ordered the striking university lecturers to resume work pending the resolution of their dispute with the government.

However, ASUU, which was not satisfied with the NIC ruling, filed an application at the Court of Appeal (Abuja Division), through its counsel, Femi Falana (SAN), seeking leave of court to file an appeal against the industrial court order.

But in its ruling on Friday, the three-man panel of the appellate court headed by Justice Hamma Barka, upheld the National Industrial Court ruling and ordered the striking lecturers to resume duty with effect from Friday, October 7 (today).

However, the court, according to a Channels TV report, granted ASUU “conditional leave to appeal the order of the Industrial Court,” but insisted that ASUU must obey the order of the NIC with immediate effect.

The three-man panel noted that for ASUU to file its notice of appeal within 7 days, it must show evidence that its members have resumed work immediately; warning that failure to adhere to the order, will make the appeal incompetent before the Court of Appeal.
