Tom-West in June filed a suit before the Federal High Court in Port Harcourt against the PDP and its governorship candidate in the state, Siminialayi Fubara, over the outcome of the party’s primary election.

A suit by a governorship candidate of the Peoples Democratic Party (PDP) in Rivers State, Morgan Tom-West, was on Friday struck out by the Federal High Court sitting in Port Harcourt, Rivers State capital.

Tom-West in June filed a suit before the Federal High Court in Port Harcourt against the PDP and its governorship candidate in the state, Siminialayi Fubara, over the outcome of the party’s primary election.

Tom-West in the suit had asked the court to issue an order stopping the Independent National Electoral Commission (INEC) from recognising Fubara as the PDP’s governorship candidate.

The plaintiff claimed that the PDP announced the name of Fubara as the winner, contrary to the terms and guidelines of the Electoral Act 2022.

He further claimed that Fubara did not have the highest number of votes from delegates during the governorship primary election.

He, therefore, urged the court to disqualify Fubara.

However, the presiding judge, Justice Adamu T. Mohammed, in his judgement on Friday, dismissed Tom-West’s suit.

According to the judge, the suit lacks competence.
