Court Nullifies Adamawa Speaker's Senatorial Ticket, Bars PDP From Fielding Candidate In 2023 Elections

Justice Abdul-aziz Anka on Monday invalidated the senatorial election conducted for the PDP candidate in the central senatorial zone of the state.
 

 

The election of the Speaker of Adamawa State House of Assembly, Aminu Iya Abbas, as the senatorial candidate of the People's Democratic Party (PDP), has been nullified by a Federal High Court in Yola, the capital of the state.
Justice Abdul-aziz Anka on Monday invalidated the senatorial election conducted for the PDP candidate in the central senatorial zone of the state.
During the PDP senatorial primary conducted on May 23, Iya Abbas defeated Auwal Bamanga Tukur, D. D. Azura, Mohammed Modibbo, Ibrahim Mustapha, Ibrahim Abubakar and Abdullahi Prambe.
However, Iya Abbas' victory was challenged at the court through originating summons by Mohammed Modibbo, asking the court to void the primary election on the premise that Auwal Tukur was allowed to participate in the contest while serving as the chairman, Governing Council of Adamawa State University.
Justice Anka, in his ruling on the suit filed by Mohammed Modibbo versus the Peoples Democratic Party and four others, voided the senatorial primary elections for Adamawa Central conducted by the PDP.
The judge held that the participation of the fourth defendant, Chairman, Governing Council Adamawa State University, Alhaji Auwal Tukur, as a political appointee without compliance to the new Electoral Act 2022 violated the process.
He therefore, ruled that “the entire process is hereby nullified.”
“The only issue proved before the court is as regards the fourth defendant’s engagement in the primary election conducted, him being a political appointee i.e chairman governing council Adamawa State University, Mubi, accordingly, the entire process is hereby nullified by this honourable court.
"The consequence, of which the party, will not be able to field a candidate for the general election come 2023 because of substantial non-compliance with the Electoral Act 2022. This is the consequential judgement of the court, against the entire political party and its members," Anka delivered.
