Abuja Property Developer In Court Tackles Nigerian Attorney-General, Malami Over ‘Illegal’ Charges

An Abuja-based property developer, Mr Cecil Osakwe, has challenged the legality of a case brought against him by the Office of the Attorney-General of the Federation and the Minister of Justice, Abubakar Malami.

But Osakwe, through his lawyer, Mr Victor Giwa, accused the Federal Ministry of Justice of being used to harass and intimidate his client.

During the proceedings before Justice Binta Murtala-Nyako, Osakwe challenged the legality of the task force that investigated the process leading to the filing of the charges against him.

According to him, the task force is unknown to law.

Osakwe had through his counsel filed a motion seeking to stay the arraignment on the ground that the special investigative task force on electricity set up by the Attorney-General of the Federal, AGF, and Minister of Justice was unlawful.

He drew the attention of the court to a pending suit challenging the legality of the panel that investigated his client and appealed to the court for stay proceedings pending the determination of the suit.

Osakwe and his lawyer had accused a staff of the Nigerian National Petroleum Corporation Limited, Ms Asabe Waziri, of using the office of the AGF to intimidate and harass them.

According to him, Waziri used her influence in the ministry to get the charge filed against him and ensure that it gets to the public and soils his name.

His lawyer said the charges against his client before the court would not hold water because Asabe and those allegedly backing her in the ministry lacked evidence to substantiate their claims.
