The Lagos State Labour Party governorship candidate in the 2023 election, Gbadebo Rhodes-Vivour, has secured a court order to inspect the Bimodal Voter Accreditation System (BVAS) and other electoral materials used during the March 18 poll in the state.

Rhodes-Vivour and his political party (LP) had filed a petition before the governorship election tribunal in Ikeja, Lagos State capital, to challenge the outcome of the election in which the incumbent governor, Babajide Sanwo-Olu was declared the winner.

The Independent National Electoral Commission (INEC) declared Governor Sanwo-Olu of the All Progressives Congress (APC) the winner of the governorship election after polling a total of 762,134 to defeat his closest contender, Rhodes-Vivour of the LP who polled a total of 312,329 votes.

Rhodes-Vivour rejected the results of the election and vowed to challenge it in court. He also called for the cancellation of the governorship election.

The Labour Party also condemned the conduct of the election, saying it witnessed a series of killings, attacks on its members and supporters, and snatching of ballot boxes, among others.

On Wednesday, Rhodes-Vivour on his Twitter page confirmed that he has got an order to inspect the electoral materials in a petition he and his party filed against Governor Sanwo-Olu, the APC and INEC as 1st, 2nd and 3rd respondents respectively.

According to the court document, the petitioners/applicants are seeking “an order granting leave to the Petitioners/Appelants to move and for the Tribunal to hear and determine the present application outside the pre-hearing.

“An order directing the 3rd Respondent by itself, agents, officers and/or privies to permit the Petitioners. Applicants acting through their agents, privies, experts and/or counsel to insect the originals of INEC forms EC8A, EC8A(I), EC8AVP, EC8A(II), EC8B, EC8B(I), EC8B(II), EC8C, EC8C(I), EC8(II), EC8D, EC8D(II), EC84, EC25, EC40, EC50 AND ALL OTHER ELECTORAL FORMS AND OTHER RELEVANT DOCUMENTS AND TO OBTAIN FROM THE 3rd Respondent certified true copies of same and all other electoral forms and other relevant documents in the custody of the 3rd Respondent.”
