Court Fixes July 13 To Hear Suit Between Nigerian Secret Police, DSS, Suspended CBN Governor, Emefiele

The Federal Capital Territory, Abuja, High Court has slated July 13 for ruling in the enforcement of a fundamental rights suit filed by Godwin Emefiele, the suspended Central Bank of Nigeria (CBN) governor.
This was stated on Tuesday by Justice Hamza Muazu who fixed the date after listening to submissions made by parties in the matter.
Counsel for Emefiele, Joseph Daudu, stated in his submission that, contrary to the respondents' preliminary objection lodged to the originating summons on notice, the court had jurisdiction to hear the matter.
According to him, the charges levelled against Emefiele are state offences that the FCT High Court may consider.
Tijjani Ghazali, counsel to the federation's attorney general, informed the court that the first respondent was disputing the court's jurisdiction to hear the case brought before it by the applicant.
He said Emefiele’s arrest and detention by the State Security Service was an administrative decision of an arm of the executive.
Ghazali went on to say that an applicant's reliefs determined jurisdiction.
He asked the court to deny the plea, arguing that the claim of wrongful imprisonment was unjustified because the embattled CBN governor was being held on the order of an FCT chief magistrates' court.
Counsel for the second and third respondents, I. Awo, informed the court that an order to detain the applicant was still in effect and urged the court to reject the application with costs.

This was contained in a ruling delivered by Justice Hamza Muazu on the application filed by J.B. Daudu, SAN, counsel to Emefiele, ruling that the security operatives should grant Emefiele unrestricted access to his lawyers and relatives.
The suspended CBN governor also informed the court that he had written letters to the DSS, particularly on June 14, for the purpose of taking further instruction from him, but the DSS had refused to respond to the application.
