Nigerian Appeal Court Reinstates Former National Intelligence Agency Boss, Dauda

Delivering judgement in an appeal filed by NIA, the Judge also resolved all the contentious issues against the agency in favour of Dauda who is a respondent in the suit.

The Court of Appeal in Abuja has reinstated the former Director General of the National Intelligence Agency (NIA), Mohammed Dauda.

Justice Peter Ige on Thursday said the evidence that led to the dismissal of Dauda was frivolous and lacking in merit and awarded the sum of N1 million to the former NIA DG.

Delivering judgement in an appeal filed by NIA, the Judge also resolved all the contentious issues against the agency in favour of Dauda who is a respondent in the suit.

He, therefore, ordered that his salaries and entitlements should be paid from the day he was dismissed from office.

Justice Ige held, "Dauda should be allowed to retire in service in accordance with the stipulated laws.

"There is no evidence before the court that shows that the respondent has constituted any risk or breached any law.

"The appellant appeal is hereby dismissed for lacking in merit and the Industrial Court judgment is hereby affirmed.”

Dauda acted as the DG of the NIA from November 2017 to January 2018, when he was replaced by a substantive DG.

Dauda subsequently challenged his removal in court, saying his dismissal was wrong and did not follow due process.

According to him, no special management staff of the disciplinary committee (SMSDC) investigated the charges against him.

Dauda argued that he was not given any fair hearing afterwards.

In an earlier judgement delivered by the National Industrial Court of Nigeria (NICN), Justice Olufunke Anuwe ordered that Dauda should be reinstated as the head of the agency and that he should be paid his salaries and entitlements from March 2018 till date after it found that his dismissal violated the NIA Act.
