Supreme Court Fixes Monday To Hear PDP Candidate, Atiku’s Petition Against President Tinubu

The Supreme Court Registrar, Zainab Garba, in the notice on Thursday, announced that Atiku’s appeal had been listed for hearing on Monday.

The Supreme Court has fixed Monday October 23 for the hearing of the petition filed by the presidential candidate of the Peoples Democratic Party (PDP) in the 2023 presidential election, Abubarkar Atiku, against President Bola Tinubu’s election.

This was contained in a memo from the Supreme Court on Thursday.

The Supreme Court Registrar, Zainab Garba, in the notice on Thursday, announced that Atiku’s appeal had been listed for hearing on Monday.

It read, ”Take notice that the above appeal/motion will be listed for hearing before the Supreme Court of Nigeria sitting at Abuja on Monday, October 23, 2023.

“And further take notice that in accordance with Order 2 Rule 1(2) of the Supreme Court Rules 1985, as amended, this NOTICE is deemed sufficiently served on you if it is left at your address of service or sent by registered post and since the date of service by post is material, Section 26 of the Interpretation Act, 1964 shall apρly.”

Atiku on September 19 filed 35 grounds appeal challenging the judgment of the presidential election petitions tribunal which upheld Tinubu’s victory in the February 25 presidential election.

Recall that the five-member presidential election petition tribunal headed by Justice Hassan Tsammani, on September 6 dismissed the petitions filed by Atiku and his Labour Party counterpart, Peter Obi, for lack of merit.

Atiku, a former Vice President, had also applied to the apex court to file fresh evidence obtained from the Chicago State University (CSU) against Tinubu, as he has insisted that the academic records Tinubu submitted to the Independent National Electoral Commission (INEC) were manipulated.

Atiku is contending that Tinubu's academic records are fraught with discrepancies and forgery, hence, he is asking the Supreme Court to remove Tinubu from office.
