Tinted Glass Policy: Nigerian Court Asked To Commit IGP Egbetokun, Spokesperson Hundeyin To Prison For Contempt Of Court

The application, filed in Suit No: FHC/WR/CS/103/2025, and made available to BarristerNG was instituted by Mr. John Aikpokpo-Martins, who is suing for himself and on behalf of tinted vehicle owners across Nigeria. 

The Federal High Court sitting in Warri, Delta State, has been urged to commit the Inspector-General of Police, Mr. Kayode Egbetokun, the Force Public Relations Officer, CSP Benjamin Hundeyin, and the Assistant Inspector-General of Police in charge of Legal Services, AIG Emmanuel Aina, to prison for alleged contempt of court.

The application, filed in Suit No: FHC/WR/CS/103/2025, and made available to BarristerNG was instituted by Mr. John Aikpokpo-Martins, who is suing for himself and on behalf of tinted vehicle owners across Nigeria. 

The respondents in the substantive suit are the Inspector-General of Police and the Nigeria Police Force.

In the motion on notice brought pursuant to Section 6(6)(b) of the 1999 Constitution (as amended) and the inherent jurisdiction of the court, the applicant is asking the court to jail the named senior police officers for allegedly disobeying an order of the court made on October 3, 2025.

According to the application, the court had ordered the police to maintain the status quo pending the hearing and determination of an interlocutory injunction in the suit challenging the enforcement of the tinted glass permit policy. 

The applicant, however, alleged that despite being aware of the subsisting court order, the contemnors issued a directive and press release around December 15, 2025, directing nationwide enforcement of the tinted glass permit exercise with effect from January 2, 2025.

The applicant contended that the directive amounted to a flagrant violation of the court’s order, interference with the subject matter of the pending suit, and a breach of the legal principle of lis pendens, which restrains parties from taking steps that may prejudice ongoing litigation.

Among the reliefs sought is an order committing the Inspector-General of Police, CSP Hundeyin, and AIG Aina to prison or a correctional centre in Okere-Warri or any other lawful place of detention until they purge themselves of the alleged contempt. The applicant is also seeking an order setting aside the directive and press release on tinted glass enforcement, describing it as an act done in total disregard of the authority of the court.

The motion further asks the court to make any additional orders it deems fit in the circumstances of the case.

The application, dated December 19, 2025, was filed by Kunle Edu (SAN) & Partners, with Olukunle Ogheneovo Edun, SAN, alongside a team of lawyers, appearing as counsel to the claimant.
