HOW GOV. FASHOLA'S MINISTRY OF WORKS & INFRASTRUCTURE DEFYED LAND USE CHARGE LAWS

December 10, 2009
It is saddened to see that the same persons that enact laws are the same set of people that break such laws with inpunity. In the land Use Act Decree, government can "acquire" property for overriding public interest, and not the other way round "encrouching" on the desired property. In the month of August, the site engineer overseeing the project on the development of Adeniran Ogunsanya, wrote a nauseating derogatry letter which read thus: I am being directed to inform you that we are carrying out developent of Adeniran Ogunsanya and expect you to break down your fence within 21 days, failure to which we will do that at your expense". A stakeholders meeting was called for on the 19th August, 2009, after a strong worded letter waas sent to the officer of the Special Adviser in the Ministry of Works and Infrastructure. At the stakeholders meeting so many issues were raised, namely: Security, parking, compensation and duration. Fom the gesture of the Special Adviser, he was not prepared for the questions raised because they were not in their agenda for the benefit of the masses. It was at thestakeholders meeting that the S.A. gave directives to the contractor to build first the inner fence before pulling down the outer fences. It was also at the meeting that the S.A. told men old enough to be his father, that, he will liaise with his counterpart in the ministry of finance on compensation. And while working out of the board room, convined with the legal counsel that was with me that, there is nothing called compensation in government book. is this not BIG FRAUD! No minute of the meeting was received by all those that were present at the meeting up to date, but the presence of the contractors hardware pulling down fences. How appaulling that the state been governed by a Senior Advocate of Nigeria, will watch in silence the defying of the 1999 Land Use Charge law. Some couple of days before the recent Under 17 Youth Championship, LASTMA came calling on Adeniran Ogunsanya and its environs and towed awy more than 13 vehicles, under the instucion of the Governor of Lagos State. One heart braking scenario was the vehicle of a 75 year old woman who as aout to be rushed to the hospital. Her car was parked on her drive in and Lastma towed it away. How sad! Could Lastma be that hungry for money? I wouldn't be surprised at that because, if they - Lastma, are giving a target of N30million every month to meet. To add insult to the injury, the Ministry of Work an infrastructure have added threat to their arsenal. Threatening lives of any one that raised ay form of resistance to their contrary moves. Where on earth are we going with this. Had an interesting talk with the Director of Highways nd he told me that, if they should encounter any resistance, thy will go stariht to the governor to revoke the licences of the properties on Adeniran Ognsanya. The stand of the S.A. on that was that, the project will elongate more than the stipulated gruesome perod of 9 months. I don't know whether the governor is awhere of all these actions. The major desire of all the concerned resident of Adeniran Ogunsanya is that the Governor should address these issues: * Adequate Compensation * Provision of Parking in front of Resident * Gazzetteing the development that is been carried out on the street * Review of the proposed development, to put into consideration the nature of the serebity of te street. This will go a long way in correcting the wrongs that had been perpetrated.
