Omo-Agege Reverses Self Over Annulment Of Candidature, Runs To Appeal Court

Omo-Agege has reversed himself and filed a suit before the Court of Appeal sitting in Benin city, Edo State, to seek the leave of the court to appeal the judgment nullifying his candidature.

Ovie Omo-Agege, the senator representing Delta Central district on the platform of the All Progressives Congress (APC), has reversed his earlier "unperturbed" comment concerning his annulled candidature by the judgement of the Federal High Court 1, Asaba, Delta State.

In a judgment delivered by Justice Tosin Adegoke, the Federal High Court 1, sitting in Asaba, the Delta State capital, had on March 18, 2019, sacked the Great Ogboru/Ovie Omo-Agege factional state executive committee of the APC led by Jones Erue, and upheld the O'tega Emerhor faction led by Cyril Ogodo as the authentic state executive committee.

The judgement went further to annul all actions taken by the sacked Erue-led executive, including ward and local government congresses, party primaries and the list of candidates who emerged from Erue's factional primaries.

However, speaking through Godwin Anaughe, his Senior Special Adviser on Communications and Strategy, Omo-Agege said the Federal High Court judgement has “no moment and does not and cannot alter the status quo”.

"Senator Ovie Omo-Agege remains the senator-elect because the Electoral College that elected Senator Omo-Agege as APC candidates in the just concluded 2019 general election came into being by virtue of a consent judgement that has not been set aside,” Anaughe said.

Meanwhile, Omo-Agege has reversed himself and filed a suit before the Court of Appeal sitting in Benin city, Edo State, to seek the leave of the court to appeal the judgment nullifying his candidature.

Also in court to seek leave to appeal the judgement is Francis Waive, who was declared winner of the Delta Ughelli North, South and Udu House of Representatives seat on the APC platform.

Waive and the embattled federal lawmaker had through their counsel, Alex Izeyon (SAN), filed an ex parte motion which has been granted, to enable service on Cyril Ogodo by pasting same at the state party secretariat in Asaba, as Ogodo is now the legally recognised Delta APC chairman.

With this development, the sacked Ogboru/Omo-Agege faction of the APC has acknowledged the Ogodo-led state executive as the authentic executive in the state.

Our correspondent reliably gathered that before now, all efforts by Vice President Yemi Osinbajo to reconcile the warring factions of the party in the state and withdraw all pending court cases were frustrated by Omo-Agege.
